<br /> <br /> <br />permitted by the responsible review authority when it is clear that the open space will provide <br />direct benefit to residents of the project and subject to the following limitations: <br />a. Horizontal Mixed-Use Share. Up to thirty (30) percent of the required open space for <br />residential uses in a horizontal mixed-use project may be provided within the <br />nonresidential component of the project. <br />b. Vertical Mixed-Use Share. Up to fifty (50) percent of the required open space for <br />residential uses in a vertical mixed-use project may be provided within the nonresidential <br />component of the project. <br />c. Child Care Facility Share. Open space required for on-site Child Care Centers may also be <br />utilized for required residential open space per the following: <br />1. The open space shall meet all State licensing requirements; <br />2. The requirements of 7(a) or 7(b) in this section are met, and; <br />3.
