36 <br /> <br />Boards, Commissions, and Committees Handbook| SeptemberMay 2024 2021 <br />As specified in state law, it is illegal for a BCC member to have an interest in any contract, sale, <br />purchase, finding or transactfon in which the member is involved in an official capacity. Actfon <br />taken where a conflict of interest exists may disqualify the commission member and invalidate <br />that BCC actfon. Any interest, whether personal, private, general or sentfmental that would tempt <br />a commissioner to act in any manner other than the best public interest should be examined and <br />official actfon accordingly restricted. An interest that is common to all similarly situated persons <br />is not disqualifying to an actfon. <br /> <br />ETHICS TRAINING <br /> <br />Certain limitatfons have been placed upon the powers of the City Council and its appointed <br />Boards, Commissions, and Committees by both statutory and case law. In certain instances, <br />applicatfon of these restraints may be crucial <br />in the government process. In instances of doubt, the City Attorney's opinion should be sought. <br />Appointed BCC members must take ethics training and are solely responsible for compliance <br />and submitting their certificates of completion to the City Clerk. This is not required of <br />applicants. <br /> <br />State law requires specified local officials to receive two hours of ethics training. The requirement <br />applies to local officials who either receive compensatfon for their service to the City or are <br />reimbursed for their expenses. The training must cover both ethics laws and ethics principles. <br />Currently, it has been determined that this is a requirement of all BCC members primarily because <br />some BCC members get reimbursed for expenses associated with performing their job on a Board, <br />Committee, or Commission. <br /> <br />The government code mandates that ethics training be provided – <br />1. If a local agency provides any type of compensatfon, salary or stfpend to a member of a <br />legislatfve body, or <br />2. If it provides reimbursement for actual and necessary expenses incurred by a member of <br />a legislatfve body in the performance of official dutfes (Cal. Govt. Code 5324, 53235.2) <br /> <br />A legislatfve body means the governing body (City Council) and also “a commission, committee, <br />board, or other body of a local agency, whether permanent or temporary, decision making or <br />advisory, created by charter, ordinance, resolutfon, or formal actfon o f a legislatfve body. “(Cal. <br />Govt.
