The Engineering and Transportation <br />Department has determined the improvements outlined by the project plans and specifications have been <br />successfully completed, therefore, staff recommends acceptance of the project. <br />One change order for a total of $1,322.86 was issued (0.84% of the awarded contract amount), resulting <br />in an adjusted contract price of $158,689.86. The change order authorized the addition of a bonding agent <br />where the new wall met the existing ones, to build a more resilient structure and prevent water infiltration <br />at the joints. This material was not specified in the project documents. <br />FISCAL IMPACT <br />Funds for this Project were previously approved and appropriated in the Fiscal Year 2023-2024 budget in <br />the Capital Projects Fund – Storm Drain (Creeks). The original contract amount was $157,367 and the <br />final contract amount is $158,689.86, an increase of less than 1% and within the approved project <br />contingency. <br />ENVIRONMENTAL REVIEW <br />The recommended project acceptance is not a project under the California Environmental Quality Act <br />(CEQA) as defined by CEQA Guidelines, section 15378, because it has no potential for resulting in either a <br />direct or reasonably foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to accept the project or authorize the release of bonds and retention. <br />However, this would be contrary to the terms of the contract, prior Council action, and public contracting <br />code. <br />ATTACHMENTS <br />None. <br />6.F. - Page 3 of 4 <br />128
