To help administer the program, tobacco retailers are required to pay an annual fee of <br />$672. <br />The County is encouraging cities within San Mateo County to adopt this model ordinance and has <br />indicated that it will administer the permit program and provide enforcement for cities that adopt it <br />without alteration. Since the County established their new tobacco retailer regulations, the following <br />cities have adopted the County’s model ordinance: <br />Brisbane <br />East Palo Alto <br />Menlo Park <br />Millbrae <br />San Carlos <br />San Mateo <br />Unincorporated parts of the County, including North Fair Oaks, are also covered by the County’s <br />ordinance. <br />Other Ordinances <br />On February 5, 2024, the City of Burlingame established their own Tobacco Retailer Permit Program to <br />allow on-site hookah consumption at up to two permitted hookah tobacco retailers, so long as they offer <br />a non-tobacco alternative to customers, as well. No local ordinance may alter other aspects of State law <br />surrounding hookah sales. Therefore, an indoor hookah establishment located in Burlingame would need <br />to meet the requirements of a “retail tobacco shop” or “private smokers’ lounge”, meaning the <br />establishment could not sell food, drink, or alcohol. <br />The Burlingame ordinance largely mirrors the San Mateo County ordinance in its fees ($672 annually), its <br />location-based restrictions for new permittees, and enforcement checks. The program is administered by <br />the Burlingame Police Department, and permits existing retailers with a valid, State-issued tobacco <br />licenses to apply for a permit at their current location, not subject to the location-based requirements of <br />the new program. <br />The City of Burlingame is responsible for all costs to administer their new program. <br />Background on City Smoking Regulations <br />Redwood City’s smoking regulations regarding smoking in public are limited to enclosed public spaces, <br />with specific restrictions for multifamily homes (Chapter 15, Article 1, Section 15.3). The regulations make <br />no mention of smoking in the public right of way; however, many other cities have prohibited smoking on <br />City property, including parking garages, streets and sidewalks; and/or commercial corridors.
