<br />55 <br /> <br />18.3.9 Employees who want to provide parental care to newborn infants or <br />to care for an adoptive or foster child placed in the employee’s home <br />in the last twelve (12) months may do so in accordance with the <br />Department’s Parental Leave Provisions. <br /> <br />18.4 Industrial Disability Leave <br /> <br />Any regular employee in all classifications who has suffered any disability arising <br />out of and in the course of their employment, as defined by the Workers' <br />Compensation Laws of the State of California, shall be entitled to industrial <br />disability leave without loss of compensation for the period of leave necessary <br />to recover from such industrial disability, up to a maximum of one (1) year or <br />until retirement, whichever occurs first. During the period the employee is paid <br />by the City, the employee shall assign or endorse to the City any benefit <br />payments received as a result of Workers' Compensation insurance coverage. <br />The City reserves the right to withhold payment of any disability benefits until <br />such time it is determined whether or not the illness or injury is covered by <br />Workers' Compensation. However, an employee may use other leave accruals <br />during such time. <br /> <br />The benefits of sick leave and disability leave shall be mutually exclusive; and no <br />disability leave may be used for the purposes specified under Section 18.1, Sick- <br />Leave; and no sick leave benefits may be used for the purposes specified under <br />Section 18.4, Disability-Leave. <br /> <br />Employees in the above-mentioned classifications shall continue to accrue sick <br />leave and vacation leave benefits and receive payment for holidays during the <br />period of disability to a maximum of one (1) year or until retirement, whichever <br />occurs first. <br /> <br />18.5 Military Leave <br /> <br />Military leave shall be granted by the City in accordance with the provision of <br />state and federal laws, and there may be a deduction for any military <br />compensation that the employee receives for service during the period that they <br />are receiving full pay from the City, if permitted by law. All employees taking <br />military leave shall give the City an opportunity, within the limits of military <br />regulations, to determine when such military leave shall be taken. <br /> <br />18.6 Leave of Absence Without Pay <br /> <br />Any employee desiring a leave of absence without pay from employment for any <br />reason shall secure written permission from the Personnel Officer and the Fire <br />Chief.
