<br />74 <br /> <br /> <br />It is agreed that reference to a minimum number of on-duty suppression personnel shall <br />be deleted from the departmental rules and all other City documents, and the <br />requirement to maintain any such minimum is no longer in effect. <br /> <br />Due to the COVID-19 pandemic and its impact on the Fire Department’s workload and <br />staffing, effective within ninety (90) days of City Council approval of a successor MOU in <br />2022, the City will create and begin the recruitment process to fill three (3) temporary <br />Firefighter full time equivalent (FTE) positions, in addition to FTE position allocations <br />provided for in the City budget as of the date of this agreement. This temporary staffing <br />is intended to provide relief from the effects of COVID-19 on the department. <br /> <br />Upon expiration of the MOU on June 30, 2023, the three temporary FTE positions will be <br />eliminated and the number of Firefighters in the bargaining unit will be reduced through <br />attrition by three (3) Firefighter FTE. <br /> <br />Upon completion of the Standards of Coverage Study, either party will have the right to <br />re-open the MOU for purposes of negotiating any minimum daily staffing changes <br />recommended and/or supported by the Study. Nothing in this proposal or the final <br />language adopted in the MOU prevents the City from staffing the Fire Department above <br />the minimum staffing levels set forth in the MOU. Within six (6) months of City Council <br />approval of a successor MOU, the City will begin a study of overtime and staffing for <br />Firefighter/Engineer and Firefighter/Engineer Paramedics. The Department Staffing <br />Committee in conjunction with Human Resources and Finance will draft the RFP. <br /> <br />SECTION 27 – PHYSICAL FITNESS PROGRAM <br /> <br />The City shall continue during the term of this MOU the mandatory Physical Fitness <br />Program for all Fire Fighter/Engineers and Fire Captains who are assigne d to a twenty- <br />four (24) hour work shift. There shall be no cost to the City for the Physical Fitness <br />Program, and it shall normally be conducted between the hours of 0830 and 0930 hours, <br />but the company officer may determine other times for physical activity as needed. <br /> <br />The parties agree that the Safety Committee can establish guidelines on any prohibited <br />physical fitness activities. <br /> <br />SECTION 28 – DRUG-FREE FIRE PROTECTION SERVICES <br /> <br />The Parties agree that providing fire protection and emergency services to the <br />community, and the illegal use or possession by employees of drugs, are incompatible <br />and unacceptable. <br /> <br />It is the obligation of employees not to be impaired due to drug use when they are to <br />report for, or when they are on duty; not to possess illegal drugs or to possess prescription <br />6.A. - Page 85 of 99 <br />92
