Flat fees submitted in conjunction with an application are nonrefundable. <br />C. Applications deemed withdrawn. <br />1. Response required. If a subdivider does not pay required supplemental fees or <br />provide information requested in writing by the City within six months following the <br />date of the request letter, the application shall expire and be deemed withdrawn <br />without any further action by the City. <br />2. Resubmittal. After the expiration or withdrawal of an application, future City <br />consideration shall require the submittal of a new complete application and <br />associated filing fees. <br />Sec. 30.10. – PUBLIC NOTICE AND HEARINGS: <br />When public notice and hearing is required by this Chapter, such notice and hearing shall <br />be given as specified in Government Code Section 66451.3. In addition, the City shall notify <br />owners of record of adjacent land and any land within 300 feet of the boundaries of the <br />proposed subdivision or other approval granted pursuant to this Chapter of such hearing. <br />Sec. 30.11. – APPEALS; CALL-UPS: <br />All decisions of the Zoning Administrator, City Engineer, and Planning Commission required <br />by this Chapter may be appealed or called up in accordance with Chapter 1, Article III of the <br />Municipal Code. Notwithstanding the foregoing, ministerial decisions and approvals <br />(including decisions related to Urban Lot Splits in Article XII and Ministerial Maps in Article <br />XIII) are not appealable and shall not be called up for review. <br />Sec. 30.12. – VIOLATIONS AND ENFORCEMENT: <br />A. General. The City shall enforce this Chapter in compliance with Government Code <br />Sections 66499.30 through 66499.38. <br />B. Penalty for violation. Penalties for violation of this Chapter and the Subdivision Map Act <br />include imprisonment and/or fine, invalidation of conveyance, denial of permits and <br />approvals, and other legal actions. <br />C. Notice of violation. If the City has knowledge that property may have been divided in <br />violation of this Chapter or the Subdivision Map Act, the City shall conduct notice of violation <br />proceedings in accordance with Government Code Section 66499.36. <br />
