REV: 08-28-24 LF <br />EXHIBIT “A” <br />I. Scope of Services <br />Contractor shall provide all labor, equipment, materials, tools, and incidentals required to <br />provide landfill disposal service to the Public Works Department for as-needed disposal <br />of the Department’s soils and mixed material construction debris. Debris may include <br />items such as, but not limited to, asphalt, base rock, concrete, dirt, and other non- <br />hazardous materials. <br />Special Waste <br />Definitions: <br />Special Waste. Special Waste is any nonhazardous solid waste at City locations <br />which, because of its physical characteristics, chemical make-up, or biological <br />nature requires either special handling, disposal procedures including liquids for <br />solidification at the landfill, documentation, and/or regulatory authorization, or <br />poses an unusual threat to human health, equipment, property, or the <br />environment. Special Waste must conform in all respects with a Contractor- <br />approved Special Waste Profile. <br />Special Waste Profile. Special Waste Profile means Contractor’s form of <br />documentation that City must complete, and Contractor must approve, with respect <br />to any Special Waste prior to Contractor’s acceptance of such Special Waste. <br />Acceptable Waste Documentation. Acceptable Waste Documentation shall mean <br />any Special Waste profile(s) (including any approved changes and re- <br />certifications), manifests, any other documentation that City is required to submit <br />to Contractor in connection with the transportation and disposal of Acceptable <br />Waste, and any permits and approvals that may be applicable to the transportation <br />and disposal of such Acceptable Waste (collectively, the “Acceptable Waste <br />Documentation”). <br />Acceptable Waste. Only waste that satisfies each of the following criteria shall be <br />accepted for transportation to and disposal at the facility (“Acceptable Waste”): (a) <br />the waste conforms to the description set forth in the Acceptable Waste <br />Documentation; (b) the waste does not contain any Unacceptable Waste; (c) the <br />waste is accurately reflected on any Special Waste Profile(s) as directed by City; <br />(d) the waste is acceptable for transportation to and disposal at the facility under <br />all Applicable Laws; and (e) the transportation to and disposal of the waste at the <br />facility is otherwise in accordance with this Agreement. The parties may <br />incorporate additional Acceptable Waste as part of this Agreement if City has <br />provided appropriate Acceptable Waste Documentation for such Acceptable <br />Waste and Contractor has approved disposal of such Acceptable Waste in writing <br />ATTY/AGR.2024.150/Browning-Ferris Industries of California, Inc.
