DocuSlgn Envelope ID: 6133B70A-ABEB-4A79-BC40-FBD5DFA34671 <br />RESOLUTION NO. 2024 — 7678 <br />RESOLUTION OF THE TOWN COUNCIL OF TOWN OF WOODSIDE: <br />(1) APPROVING A SEWER SERVICE ALLOCATION FOR 1595 CANADA LANE, <br />PURSUANT TO MUNICIPAL CODE SECTION 51.126; (2) CONSENTING TO THE <br />ANNEXATION OF THIS PROPERTY INTO THE TOWN CENTER SEWER ASSESSMENT <br />DISTRICT; AND (3) AUTHORIZING THE TOWN MANAGER TO EXECUTE REVISED <br />AGREEMENTS WITH THE CITY OF REDWOOD CITY AND THE FAIR OAKS SEWER <br />MAINTENANCE DISTRICT TO ADD THIS PROPERTY INTO THE APPROVED SERVICE <br />AREA FOR THE TOWN CENTER ASSESSMENT DISTRICT <br />WHEREAS, the Woodside Municipal Code provides Sewer Service <br />Allocation Regulations beginning at Section 51.120; and <br />WHEREAS, the parcel at 1595 Canada Lane is in "Area III" as <br />defined in Section 51.123 of the Sewer Service Allocation Regulations; <br />and <br />WHEREAS, Section 51.126 of the Municipal Code provides the <br />process whereby parcels that lie in "Area III" may connect to sewer; <br />and <br />WHEREAS, the owners of the parcel at 1595 Cafiada Lane have <br />applied for a sewer service allocation under the terms of this <br />section; and <br />WHEREAS, the Town Engineer has reviewed the application and finds <br />that the parcel meets all the conditions as provided in Section <br />51.126; and <br />WHEREAS, the allocation of sewer service to this parcel is <br />consistent with the General Plan and reserved sewer capacity is <br />available; and <br />WHEREAS, the property owners have deposited the required funds <br />with the Town for the Town Council hearing; and <br />WHEREAS, the legislative bodies of Redwood City and the Fair Oaks <br />Sewer Maintenance District will need to agree to amend the agreements <br />that both those agencies have with the Town of Woodside pertaining to <br />the Town Center Sewer Assessment District in order to allow this <br />property to be annexed into the District and the Town will need to <br />execute amended agreements accordingly. <br />NOW THEREFORE, IT IS HEREBY RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF WOODSIDE that: <br />1. A sewer service allocation is granted in the Town Center Sewer <br />Assessment District to 1595 Caflada Lane; <br />2. It consents to the annexation of this property into the Town <br />Center Sewer Assessment District; and <br />3. The Town Manager is authorized to execute amendments to the <br />agreements with Redwood City and the Fair Oaks Sewer <br />RESO. 2024-7678 <br />05/28/2024 <br />ATTY/AGR.2024/Amend.
