Therefore, the exception under CEQA Guidelines <br />Section 15300.2(c) does not apply to the project. <br />Criterion 15300.2(d): Scenic Highway <br />d. A categorical exemption shall not be used for a project, which may result in damage to <br />scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or <br />similar resources, within a highway officially designated as a State Scenic Highway. This <br />criterion does not apply to improvements required as mitigation by an adopted Negative <br />Declaration or certified EIR. <br />The project site is not within view of an officially designated State scenic highway. The closest <br />official State scenic highways are Interstate 280 (I-280) and State Route 35 (SR-35).17 The project site <br />is not visible from any of these designated scenic highways. Therefore, no scenic resources within <br />view of a State Scenic Highway would be altered as part of the project, and CEQA Guidelines Section <br />15300.2(d) does not apply to the project. <br />Criterion 15300.2(e): Hazardous Waste Sites <br />e. A categorical exemption shall not be used for a project located on a site, which is included on <br />any list compiled pursuant to Section 65962.5 of the Government Code. <br />The project site, which is primarily limited to above-water facilities in Redwood Creek, is not <br />included on the list of hazardous materials release sites compiled pursuant Government Code <br />Section 65962.5. However, the adjacent 1548 Maple Street site is listed as a Leaking UST cleanup <br />site on the State Water Board’s GeoTracker online database, with a “completed – case closed” <br />status as of September 1990. The adjacent 1548 Maple Street site is also listed as a cleanup site on <br />DTSC’s Envirostor online database, with a “no further action” status as of June 2010. A closed site <br />indicates that regulatory requirements for response actions, such as site assessment and <br />remediation, have either been completed or were not necessary and therefore potential migration <br />of residual contaminants in groundwater beneath the project corridor (if any) does not likely pose a <br />risk to human health and the environment. <br />As outlined in the Project Description, standard Construction Conditions, as specified in Section VI. <br />Conditions of the General Order would be implemented to minimize the risk of spills or accidental <br />discharge of hazardous materials during deconstruction activities.
