<br />28 <br /> <br />Employees who die while in the employ of the City shall be eligible to <br />receive compensation for twenty-five percent (25%) of accrued unused <br />sick leave. <br /> <br />Employees who die in the line of duty or whose death is determined to be <br />directly attributable to injury or illness sustained while on duty shall be <br />eligible to receive compensation for one-hundred percent (100%) of <br />accrued unused sick leave. <br /> <br />In the event of the death of a unit member, such payments shall be made <br />to the designated beneficiary filed with the Director of Finance, or, in the <br />event no designated beneficiary has been chosen, the beneficiary listed in <br />the unit member's insurance policy will receive payment of such unused <br />sick leave in the applicable amount as provided in this Section 9.1.7. <br /> <br />Unit members discharged for disciplinary reasons shall not be eligible for <br />payment of unused sick leave. <br /> <br />9.1.8 Unused accumulated sick leave at the time of retirement, for which the <br />employee receives no compensation, shall be converted to additional <br />service credit at the rate of 0.004 years of service for each day, i.e., two <br />hundred fifty (250) days of sick leave shall equal one additional year of <br />service credit. <br /> <br /> Local safety member benefits subject to a maximum of ninety percent <br />(90%) of the average final compensation will not be increased beyond that <br />limit for unused sick leave credit. <br /> <br />9.2 Industrial Disability Leave <br /> <br />Any safety employee as defined by the MOU between the City and the Public <br />Employees' Retirement System, who has suffered a disability arising out of and in <br />the course of their employment, as defined by Workers' Compensation Laws of the <br />State of California, shall be entitled to industrial disability leave while so disabled <br />without loss of salary, for the period of such disability to a maximum of one (1) <br />year or until the condition is permanent and stationary or until retirement, <br />whichever occurs first. During the period the employee is paid by the City, the <br />employee shall assign or endorse to the City any benefit payments received as a <br />result of Workers' Compensation Insurance coverage. <br /> <br />The City reserves the right to withhold payment of any disability benefits until such <br />time as it is determined whether or not the illness or injury is covered by Workers' <br />Compensation. <br /> <br />A safety employee on industrial disability leave shall accrue sick leave and vacation <br />in accordance with the Workers' Compensation laws of the State of California. <br /> <br />6.I. - Page 40 of 84 <br />270
