ATTY/RESO.0088/ CC RESO ADOPTING UPDATED TRANSPORTATION IMPACT FEE PROJECT LIST <br />REV: 11-27-24 MI <br />Page 1 of 2 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY ADOPTING AN UPDATED TRANSPORTATION IMPACT FEE <br />PROJECT LIST AS THE CAPITAL IMPROVEMENT PLAN FOR THE <br />TRANSPORTATION IMPACT FEE PROGRAM IN COMPLIANCE WITH <br />GOVERNMENT CODE SECTIONS 66016.5 AND 66002 <br />WHEREAS, Article XV of Chapter 18 of the Redwood City Municipal Code <br />imposes Transportation Impact Fees on new development projects and requires the City <br />to maintain a Transportation Impact Fee Project List, which sets forth the transportation <br />improvements to be funded in whole or in part by the Transportation Impact Fee revenues; <br />and <br />WHEREAS, Government Code section 66016.5 requires certain jurisdictions to <br />adopt a capital improvement plan when they adopt new or updated impact fees; and <br />WHEREAS, when the City updated its Transportation Impact Fee it also adopted <br />a Transportation Impact Fee Project List as the capital improvement plan for the fee in <br />accordance with Government Code sections 66016.5(a)(6) and 66002; and <br />WHEREAS, the Transportation Impact Fee Project List indicates the approximate <br />location, size, time of availability, and estimates of cost for all facilities or improvements <br />to be financed with the fees; and <br />WHEREAS, the City Council must annually update the Transportation Impact Fee <br />Project List, pursuant to Government Code section 66002, at a noticed public hearing; <br />and <br />WHEREAS, the City Council held a public hearing, notice of which was provided <br />pursuant to Government Code sections 66002 and 65090. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />SECTION 1. This resolution has been reviewed with respect to applicability of the <br />California Environmental Quality Act (“CEQA”) and the CEQA Guidelines. The resolution <br />is not a project under Public Resources Code section 21065 and CEQA Guidelines <br />section 15378(b)(4) because the resolution does not have the potential for resulting in <br />either a direct physical change in the environment, or a reasonably foreseeable indirect <br />physical change in the environment, as the resolution concerns government funding <br />mechanisms which do not involve any commitment to any specific project. The resolution <br />is also exempt from CEQA as there is no possibility for causing a significant effect on the <br />environment, per CEQA Guidelines section 15061(b)(3).
