Page 7 of 10 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.org <br /> <br />Notably, those who were not in favor of additional regulation cited various reasons for not supporting it, <br />including that they didn’t find smoking in public to be a general problem and that the City should instead <br />focus on other problems. They also were concerned about nature of the enforcement, including who <br />would enforce and how likely it was that enforcement would occur. <br />Recommendation <br />Taking into account the City’s commitment to public health, coupled with the results of the community <br />outreach earlier described in this report, staff recommends a reorganization of Chapter 15, and updates <br />for consistency with state law, adding new prohibitions in Article II to include a ban on smoking in the <br />following areas: <br />1. Pedestrian Malls, defined as Streets, or portions thereof, on which vehicle traffic is restricted in whole <br />or in part and which is to be used exclusively or primarily for pedestrian travel; and <br />2. 20 feet from restaurant and bar entrances, exits, and operable windows. <br />In addition, staff recommend making the following changes outlined in Table 4 to provide more clarity in <br />the ordinance: <br />Table 4 – Summary of Additional Proposed Changes in the Ordinance <br />Section Changes <br />Article I – Local Smoking Regulations Rename Article to “In General” <br />Update Definitions <br />Add Severability Clause <br />Article II – Enforcement of Statewide Smoking <br />Prohibitions <br />Rename Article to “Local Smoking <br />Regulations” <br />Update with reference to California Labor <br />Code 6404.5 <br />Add local prohibition on smoking in certain <br />places in the public right-of-way <br />Article III – Tobacco Retailer Permit Add reference to Article VI for enforcement <br />authority <br />Article IV – Penalties Move to end of Chapter and renumber as <br />Article VI, Enforcement and Penalties, to <br />clarify enforcement authority. (Where <br />relevant, some penalties remain codified in <br />individual Articles.) <br />Article V – Prohibiting Smoking In and Around <br />Multi-Unit Residences <br />Renumber as Article IV <br />Consolidate Definitions to Article I <br />Add reference to Article VI for enforcement <br />authority <br />8.A. - Page 7 of 37 <br />233
