Adopt a resolution approving an exception to the Public Employees’ Pension Reform Act 180-day <br />waiting period and appointing retired annuitant Ramoth Iverson as Interim Fire Chief effective January 20, <br />2025, or upon CalPERS approval to hire, whichever is later; and <br />2. Adopt a resolution approving an exception to the Public Employees’ Pension Reform Act 180-day <br />waiting period and appointing retired annuitant Jacqueline Barberini to perform critical extra help Public <br />Safety Communications Dispatcher duties effective January 14, 2025, or upon CalPERS approval to hire, <br />whichever is later. <br />STRATEGIC PLAN GUIDING PRINCIPLE <br />Excellence in Government Operations <br />BACKGROUND <br />Assembly Bill 340, the Public Employees’ Pension Reform Act of 2013, also known as PEPRA, was signed <br />into law on September 12, 2012 and went into effect on January 1, 2013. PEPRA created Government <br />Code Section 7522.56, which requires public agency retirees to wait 180 days after an employee has <br />retired before allowing them to return to work for a public agency. Government Code Section <br />7522.56(f)(1) provides an exception to this waiting period, if the City Council determines that the <br />appointment of a retiree is necessary to fill a critically needed position and that the appointment has been <br />approved by the governing body of the employer in a public meeting. <br />8.B. - Page 1 of 21 <br />264
