Code LANDSCAPE MAINTENANCE AGREEMENT Stanford Health Care, Block E THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into this 6� day ofCµ9�2 2024 ("Effective Date"), by and between Stanford Health Care, a California nonprofit public health corporation ("Developer"), and the CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City') (together, the "Parties") with reference to the following facts: RECITALS A. Developer is the current fee owner of that certain real property located within the City of Redwood City, County of San Mateo, State of California, described in Exhibit "A", attached hereto and incorporated herein by reference (the "Property"). B. On December 5, 2023, the Planning Commission of the City of Redwood City adopted, among other approvals, Resolution No. 23-23, approving a Tentative Map TM2019-005, on the Property subject to certain conditions of approval ("Conditions"). C. In compliance with the Conditions, Developer submitted to City landscaping plans for the Property frontage ("Plans"), which have been approved by City. The Plans provide for installation of certain improvements contemplated bV the project: i.e. landscaping, pedestrian lighting, irrigation, private roads, pedestrian paths, street tree, and sidewalk curb and gutter ("Improvements") within public rights of way, easements, and on property in which the City hold and interest to be maintained ("Maintenance Area") as the Improvements and Maintenance Area are more specifically shown on Exhibit "B", attached hereto and incorporated by this reference as if fully set forth herein. D. Developer has submitted a final map for the Property, which has been reviewed by the City Engineer and is being approved concurrently with this Agreement ("Final Map"). E. Developer recognizes that City's approval of the Final Map is based on Developer's commitment to the long-term maintenance, repair, care and, if and when necessary, replacement of the Improvements, and that the Final Map would not have REV: 10-25-24 VR ATTY/AGR.2024.208/Stanford Health Care (500 Broadway Stanford Block E - LMA) (Page 1 of 13)
