Attachment B – Recent State Tenant Protections and Mobilehomes Legislation <br />California Tenant Protections that went into effect in 2024 <br />Bill Key Elements of the Bill <br />AB 12 <br />(Security <br />Deposits) <br />Limits security deposits to 1 month’s rent except for certain small landlords. <br />Effective July 1, 2024 <br />SB 567 <br />(Termination) <br />Amended the following No-fault Just Cause provisions of the Tenant Protection Act (AB <br />1482): <br />Owner Intent to Occupy: <br />o The property owner or family member (spouse, domestic partner, parent, <br />child, grandchild, grandparent) must move into the unit within 90 days after <br />tenant vacates AND continuously occupy the unit as their primary residence <br />for at least 12 months. <br />Intent to demolish or to substantially remodel the residential real property: <br />Requires an owner who displaces a tenant to substantially remodel or demolish a unit <br />to provide the tenant with written notice providing the tenant with specific <br />information, including: <br />o A description of the substantial remodel to be completed <br />o The expected duration of the repairs, or the expected date by which the <br />property will be demolished <br />o A copy of permits required to undertake the substantial remodel or <br />demolition, as applicable <br />o A statement that if the substantial remodel or demolition of the property as <br />described in the notice of termination is not commenced or completed, the <br />owner must offer tenant the opportunity to re-rent the unit with a rental <br />agreement containing the same terms as the most recent rental agreement <br />with the owner at the rental rate that was in effect at the time the tenant <br />vacated. <br />New Enforcement Mechanisms: <br />o Owners who recover possession in violation of the above laws are liable to <br />the tenant in a civil action for damages of up to 3 times the actual damages, <br />in addition to punitive damages. <br />o Landlords that collect rent payments in excess of the maximum allowable <br />increase may be liable to pay back up to three times the excess amount, <br />especially if the overcharging was done willfully or fraudulently. <br />o The bill also authorizes Attorney General, County Counsel or City Attorney to <br />bring actions for injunctive relief against the owner. <br />Effective April 1, 2024 <br />8.A. - Page 18 of 21 <br />176
