Within 20 feet of any entrance, exit, window, or other opening into a restaurant or bar. <br />C. Smoking is prohibited in all places within the City where smoking is prohibited pursuant to the State Indoor <br />Clean Air Act of 1976, Health and Safety Code Section 118875 et. seq. <br />D. Notwithstanding any other provisions of this Section, any owner, operator, manager or other person who <br />controls any establishment described in this Section may declare that the entire establishment is a <br />nonsmoking establishment. <br /> <br />Sec. 15.7. POSTING OF SIGNS: <br /> "No Smoking" signs with letters of not less than one inch (1″) in height, or the international "No Smoking" <br />symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar <br />across it) shall be clearly, sufficiently and conspicuously posted in every building or other place where <br />smoking is controlled by this Chapter, by the owner, operator, manager or other person having control of <br />such building or place. <br /> <br />Sec. 15.8 ENFORCEMENT AND PENALTIES <br />A. Violations of this Article may be enforced by the City’s law enforcement agencies, including Code <br />Enforcement and the Chief of Police, or their designee. <br />B. In the performance of their duties of monitoring and enforcing compliance with the provisions of Labor <br />Code Section 6404.5 or other provisions of this Article, all persons so authorized by Code Enforcement <br />or the Chief of Police shall have the power, authority and immunity of a public officer to issue infractions <br />or citations. <br />C. Any person who violates this Article shall be guilty of an infraction, punishable as set forth below, or <br />issued citations as set forth below, at the discretion of the law enforcement agency, including code <br />enforcement: <br />1. A fine not exceeding one hundred dollars ($100) for a first violation. <br />2. A fine not exceeding two hundred dollars ($200) for a second violation within one (1) year. <br />3. A fine not exceeding five hundred dollars ($500) for each additional violation within one (1) <br />year. <br />D. In addition to the above, the City may enforce this Article as authorized by the enforcement and <br />penalties provisions of Article VI. <br />Secs. 15.9—15.19. RESERVED: <br />
