Date: 01/22/2025 <br />AUTHORITY, PURPOSE, AND SCOPE OF WORK <br /> <br />1. Authority <br /> <br />The State of California has established the Encampment Resolution Funding Program <br />of Division 31 of the Health and Safety Code. ERF was amended by AB 166 (Statutes <br />of 2024, Chapter 48, Sec.14-15, effective July 2, 2024). <br /> <br />The Program is administered by the California Department of Housing and Community <br />Development (HCD ) in the Business, Consumer Services and Housing Agency <br />-time, competitive grant funds to Continuums of Care and <br />/ or Local Jurisdictions as defined below. To date, there have been three previous <br />rounds of the Encampment Resolution Funding Program. This Standard Agreement <br />governs the Lookback Disbursement in Round 4 of the ERF Program (ERF-4-L ). For <br />this Standard Agreement, ERF-4-L and refers <br />to programs and grantees under Health and Safety Code 50252.1(b). <br /> <br />HCD and a Continuum of Care or a Local J <br />and in furtherance of, the purpose of the Program. In signing this Agreement and <br />thereby accepting this award of funds, the Grantee agrees to comply with the terms and <br />conditions of this Agreement, the Notice of Funding Availability dated <br />November 27, 2023, under which the Grantee applied, the representations contained in <br />the application, HCD guidance or directives, and the requirements appearing <br />in the statutory authority for the Program cited above. <br /> <br />2. Purpose <br /> <br />As stated in the NOFA, the Program objective is to fund actionable, person-centered <br />local proposals that resolve the experience of unsheltered homelessness for people <br />residing in encampments. Resolving these experiences of homelessness will <br />necessarily address the safety and wellness of people within encampments, resolve <br />critical encampment concerns, and transition individuals into interim shelter with clear <br />pathways to permanent housing or directly into permanent housing, using data <br />informed, non-punitive, low-barrier, person-centered, Housing First, and coordinated <br />approaches. These projects must comply with the principles of Housing First as defined <br />in Welfare and Institutions Code section 8255. Proposals may bolster existing, <br />successful models and/or support new approaches that provide safe stable, and <br />ultimately permanent housing for people experiencing homelessness in encampments. <br />Expenditures shall be consistent with the legislative intent of the authorizing statute to <br />ensure the safety and wellness of people experiencing homelessness in encampments. <br /> <br />ATTY/AGR.2025.017/State of California Department of Housing and Community Development (Encampment Resolution Funding Program)(REV: 02-07-25 MI) (Page 3 of 25) <br />6.D. - Page 9 of 32 <br />89
