<br /> <br />00059814-1 <br /> 35 <br />x If the employee brings or responds to a suit, or is summoned to provide testimony in a nonofficial <br />capacity, in a proceeding to which the City is not party; or <br />x In court if appearing voluntarily. <br /> <br />18.11 Personal Business Leave <br /> <br />18.11.1 An employee shall be entitled to a maximum of two (2) days per year for Personal Business <br />Leave for any reason without loss of pay. Such leave shall be deducted from accrued sick leave. <br /> <br /> 18.11.2 An employee must secure advance permission for all Personal Business Leave as defined <br />above, and shall normally notify the department head two (2) days before taking this leave, <br />unless any emergency exists which prohibits the employee from providing such advance notice. <br /> <br /> <br />ARTICLE 19 - HEALTH PLANS <br /> <br />19.1 Health and Cafeteria Plans <br /> <br /> 19.1.1 The City agrees to contract with the California Public Employee's Retirement System (CalPERS) <br />for participation under the Public Employees Medical and Hospital Care Act (Government Code <br />Section 22750, et, seq.), for the purpose of providing medical insurance benefits for employees. <br />Upon the request of the City, the parties will re-open this Article 19.1.1 to meet and confer on <br />modifying 19.1.1 to provide a different group health plan. <br /> <br />19.1.2 The City’s maximum contribution for each eligible active employee for a Health Benefits Plan (as <br />referenced in Government Code 22892) shall not exceed the CalPERS minimum contribution, <br />adjusted annually by the CalPERS Board to reflect any change to the medical care component of <br />the Consumer Price Index. <br /> <br /> 19.1.3 All costs incurred by the City to maintain the Group Health Benefits Plan in compliance with <br />Government Code Section 22751, et. seq., and all costs incurred by the City to maintain the <br />Cafeteria Plan in compliance with IRS Code Section 125, shall be paid from the aforementioned <br />monthly dollar caps identified in Sections 17.1.4, and 17.1.5. Such costs include, but are not <br />limited to, premiums, surcharges, and/or administrative fees. In the event there are any costs not <br />charged to the City due to delays by CalPERS and/or other administrative agencies in <br />calculating or reporting these costs, said costs shall be carried over and charged as <br />administrative costs to the following plan year and deducted from the aforementioned monthly <br />dollar caps accordingly. <br /> <br /> 19.1.4 Cafeteria Plan: <br /> <br />Available Benefits: The City shall establish in accordance with Section 125 of the IRS Code a <br />Cafeteria Plan for the purpose of providing employees access to various health and welfare <br />benefits. Benefits available through the Cafeteria Plan include, but are not limited to: <br /> <br /> A. Group Health Plan Medical Premiums <br /> B. Flexible Spending Account for Dependent Care <br /> C.
