<br /> <br /> <br />25 <br />voted to recommend approval of a substantially similar version of the proposed development to the Planning <br />Commission. <br />Given that the Commercial Component: (1) meets all mandatory DTPP Standards and qualifies for the requested <br />exceptions for building placement and step down zone that are permitted by the DTPP; (2) allows for the proposed <br />development to provide open space and maintain the creek; (3) is eligible for the additional height with a PDP; (4) <br />would be consistent with other higher density projects along El Camino Real; (5) requests Guideline deviations for <br />architectural style that would not conflict with the visual character of the surrounding uses; (6) and whose design was <br />recommended for approval by the AAC, aesthetic impacts related to visual character and conflicts with standards <br />governing scenic quality would be less-than-significant. There will be no new aesthetic impacts or any substantial <br />increases in the severity of previously identified significant aesthetic impacts related to the project component’s <br />architectural design. <br />The Commercial Component would have less than significant impacts on visual character or quality because, as noted <br />above, it is consistent with the DTPP and existing land uses surrounding the subject site, is within the maximum <br />allowable height, would contribute to the mounding of buildings in the City’s downtown skyline, and would enhance <br />and not detract from or contrast with the existing visual character and quality of the surroundings. The subject site is <br />located within an area which is developed with similar uses and the location, size, and design of the proposed use <br />would be similar to and compatible with the land uses in the immediate area. For these reasons, the Commercial <br />Component would be consistent with the analysis in the EIR/SEIR and would not create new impacts, increase <br />impacts, and there is no new information of substantial importance for CEQA purposes. <br />d. The Downtown Precise Plan program EIR (pp. 6-28 and 6-29) concluded that since new development within the DTPP <br />area would be required to meet the lighting power allowances for Lighting Zone 3 for new installed outdoor lighting <br />equipment contained in Title 24, Parts 1 and 6, Building Energy Efficiency Standards, unnecessary brightness of <br />lighting, debilitating glare, and sky glow would be adequately controlled. The impact of development occurring under <br />the DTPP was considered to be less than significant, and no mitigations were required. The DTPP Plan-Wide <br />Amendments program SEIR (p. 6-12) concurred with the DTPP program EIR conclusion that the impacts would be <br />less than significant because of compliance with Lighting Zone 3 and Title 24 standards reduce the impacts. <br />The proposed component is in compliance with all applicable DTPP standards regarding light and glare and, as a <br />result, no additional light and glare impacts are anticipated. Proposed new street lighting is subject to review and <br />approval by the City; as identified in the DTPP, Lumec and double head Lumec street lighting fixtures are standard <br />for City Streets (DTPP p. 59, "Public Frontage Regulations Chart"). According to component plans, the applicant <br />proposes to install new single head street lighting fixtures as follows: five along James Avenue, four along <br />Winklebleck Street, and five along the proposed Franklin Street extension; in addition, seven new double head Lumec <br />style lighting fixtures are proposed along El Camino Real (Plan Sheet LT-1, 12/10/2023). <br />These fixtures would be in compliance with Lighting Zone 3 and Title 24 standards and would thereby minimize the <br />impact of new sources of light pollution and not create a new source of substantial light or glare which would adversely <br />affect day or nighttime views in the area. For these reasons, the Commercial Component would have a less than <br />significant impact and is consistent with the analysis in the EIR/SEIR because it would not create new impacts or <br />increase impacts, and there is no new information of substantial importance for CEQA purposes. <br />e. For the Downtown Precise Plan program EIR (pp. 6-13 and 6-14), the City determined that any new structure within <br />the DTPP area that would cause identified shadow-sensitive uses and spaces to be more than 50 percent in shadow at <br />12:00 PM (noon) on the Spring Equinox (March 20) would impair the livability and beneficial uses of those shadow- <br />sensitive uses and spaces, in which case a significant environmental impact would result. <br /> The City conducted extensive and detailed studies regarding the potential shadow impacts that might result from the <br />Downtown’s expected increases in building heights (DTPP program EIR Appendix 21.3 - Supplemental Shadow <br />Analysis Information). As a result, the DTPP development standards were developed with the specific intent to avoid <br />significant shadow impacts (EIR p. 6-29). Full buildout of the DTPP to the maximum building envelopes allowed by <br />the Plan’s standards would not cause any shadow-sensitive uses and spaces (such as public parks, plazas, or open <br />space areas; buildings using passive solar heat collection or solar collectors; historic resources with a shadow-sensitive <br />character-defining feature; or shadow-sensitive portions of residential parcels) to be more than 50 percent in shadow <br />at noon on the Spring Equinox. The impact of the DTPP was considered to be less than significant, and no mitigations <br />were needed. <br /> The DTPP Plan-Wide Amendments program SEIR (pp. 6-13 through 6-14) generally concurred with the DTPP EIR <br />conclusion but determined that because development under the amended DTPP would be expected to increase, <br />ATTY/RESO.0028/CC RESO CEQA GUIDLINES (920 SHASTA) - EXHIBIT A <br />REV: 04-22-25 VR <br /> <br />Page 25 of 148
