The City Council, having independently heard, considered, and <br />weighed all the evidence in the Record, finds that the above recitals are accurate and <br />constitute findings in this matter and, together with the Project Record, have served as <br />an adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />Resolution. <br /> <br />Section 3. CEQA. In the exercise of its independent judgement, based on the facts <br />and evidence in the Record, the City Council concurrently adopted a Resolution finding <br />that, pursuant to the CEQA Consistency Checklist, the Project is exempt from further <br />environmental review pursuant to Public Resources Code Section 21083.3 and CEQA <br />Guidelines Section 15183, and does not require further environmental review under <br />CEQA. <br /> <br />Section 4. Affordable Housing Findings. The City Council is able make the <br />required findings to approve an Affordable Housing Plan (Zoning Ordinance Section <br />29.7(D)), Affordable Housing Partner, Land Donation, Land Donation Agreement in <br />substantially the form attached hereto as Exhibit C as an alternative means of compliance <br />(Zoning Ordinance Section 29.8 (H)) with the City’s Affordable Housing Ordinance, and <br />a Relocation Plan. Specifically, based on the facts and evidence in the Record, the City <br />Council finds that: <br /> <br />a. Affordable Housing Plan. The Affordable Housing Plan, attached as Exhibit B <br />was prepared in a manner consistent with the requirements in Article 29.7 of the <br />Affordable Housing Ordinance and can be approved because: <br /> <br />i. The proposed land donation meets the applicable standards in Article 29 <br />including the land donation requirements at Section 29.8 (H) and further <br />described in Section 6.c of this resolution. <br /> <br />ii. The proposed land donation for affordable housing will mitigate the impact <br />of the Project on the need for affordable housing as the value of the <br />Affordable Site is greater than the Affordable Housing Impact Fee required <br />to be paid for the Project. <br /> <br />iii. The Applicant and Affordable Housing Partner, as part of the Affordable <br />Housing Plan, have submitted to the City evidence that a viable financing <br />plan is in place evidencing the financial feasibility for the construction of the <br />affordable units on the Affordable Site. <br /> <br />iv. The Affordable Site is consistent with the Housing Element, General Plan, <br />and Zoning and will not cause residential segregation. <br /> <br />b. Qualifying Designee. The Affordable Housing Partner is a City-approved <br />Qualifying Designee as defined in the Program Guidelines because:
