REV: 05-01-25 MI <br />EXHIBIT “A” <br />SCOPE OF SERVICES <br />1. City appoints Consultant as agent to collect accounts which have been assigned <br />to the Consultant as of the Effective Date, or which may be referred for collection <br />to the Consultant during the term of the Agreement. <br />2. City authorizes Consultant to act in City's name, and to perform any and all lawful <br />acts within the provisions of the Federal Fair Debt Collection Practices Act and the <br />California Robbins-Rosenthal Fair Debt Collection Practices Act, which in the <br />judgment of the Consultant may be necessary for the collection of such accounts. <br />3. City authorizes Consultant to endorse the name of the City on such drafts, checks, <br />money orders, and other payments, payable to the City, which may be received by <br />the Consultant and deposited into their customer trust bank account, on such <br />collection accounts, subject to the obligation of the Consultant, to pay over the <br />balance of such collections to the City following the deduction of all amounts due <br />Consultant as hereinafter provided. <br />4. City agrees that all accounts in the office of Consultant as of the Effective Date, or <br />which may be referred hereafter to the Consultant, shall be retained by the <br />Consultant until canceled in writing by Consultant. Consultant agrees to cancel any <br />account within 30 days after written demand from the City, unless the account is <br />in the process of collection, or upon which legal action has been instituted. <br />5. City shall have the right to accept payment in full on any collection amount, except <br />on an account where legal action has been filed. However, all arrangements for <br />deferred or installment payments shall be made by the Consultant. <br />6. Consultant will notify the City at least six (6) months before the statute of limitations <br />expires on an assigned account. <br />7. Consultant will make a recommendation to City whether to initiate litigation on an <br />account based on the exercise of Consultant’s business judgment. Consultant <br />agrees that legal action will not be undertaken on any account without written <br />authorization from the City’s Finance Director. All costs of collection and suit shall <br />be advanced by the Consultant, unless otherwise agreed by Client. Such amounts <br />will be paid back to Consultant out of the first moneys collected for that account, <br />including, but not limited to, moneys collected from any settlement or judgment on <br />that account.
