has determined that the Affordable Housing Project at the Affordable Site complies with the City’s <br />development standards, the plans and policies set forward in the General Plan, and meets the <br />requirements of the City’s Affordable Housing Ordinance. The 901 El Camino Real Project and <br />Affordable Housing Project plans, approvals, and determinations described in this Recital are <br />collectively referred to herein as the “Project Approvals.” These 901 El Camino Real <br />Project/Affordable Housing Project Approvals include: <br />1.As further described in Recitals K and L above, on June 26, 2023, by <br />adopting Resolution No. 16153, the City Council certified the DTPP SEIR, approved the DTPP <br />Plan-Wide Amendments, adopted CEQA Findings of Fact, a Statement of Overriding <br />Considerations, and the DTPP Plan-Wide Amendments MMRP; <br />2.On __________, 2025, and as set forth in City Resolution Nos. ________ <br />and ____________, the City Council considered the CEQA Guidelines Section 15183 Consistency <br />Checklist for the 901 El Camino Real Project and Affordable Housing Project, dated September <br />13, 2024, and its findings prepared by the City’s Planning Division (collectively, the “Consistency <br />Checklist”), the DTPP EIR and the DTPP SEIR and DTPP Plan-Wide Amendments MMRP as <br />well as the Housing Element Update EIR and Housing Element Update MMRP, as recommended <br />by the Planning Commission on _________, 2025, in Resolution No. 25-______ in connection <br />with the Project Approvals, and in Resolution No. 25-_______ in connection with the Affordable <br />Housing Project approvals, and determined that there are no environmental effects which are <br />peculiar to the 901 El Camino Real Project, the Property, the Affordable Housing Project and <br />Affordable Site, nor are there any new significant effects, potentially significant off-site impacts <br />or cumulative impacts, or substantial new information which was not known at the time of the <br />DTPP EIR and DTPP SEIR or Housing Element Update EIR that identifies any significant effects <br />that were not already identified and analyzed in the certified DTPP EIR and DTPP SEIR or <br />Housing Element EIR; <br />3.On ____________, 2025, by City Resolution Nos. __________ and <br />_______, the City Council approved General Plan and DTPP Amendments specific to the 901 El <br />Camino Real Project; <br />4.On August 13, 2024, pursuant to the Surplus Land Act (Government Code <br />Sections 54220 et seq.), the State of California Department of Housing and Community <br />Development determined that the portions of California Street and Winklebleck Street that are <br />proposed to be vacated was found to be exempt surplus land pursuant to Government Code Section <br />54221(f)(1)(B) as the City Parcel is less than one-half acre and is not contiguous to land owned by <br />a state or local agency that is used for open space or low- and moderate-income housing purposes; <br />5.On________, 2025, as set forth in City Resolution No. _________, the City <br />Council approved a VTPM, a Downtown Planned Community Permit, and Use Permit, a Planned <br />Development Permit, subject to Conditions of Approval for the Project, and also approved an <br />Affordable Housing Plan authorizing the alternative compliance with the Affordable Housing <br />Ordinance, approved the Relocation Plan and the Affordable Housing Partner as a qualified <br />designee, and approved the Affordable Housing Land Donation Agreement and land donation <br />contemplated thereunder; <br />ATTY/ORD.0002/CC ORD APPROVING DEVELOPMENT AGREEMENT (901 EL CAMINO REAL) - EXHIBIT A <br />REV: 04-23-25 VR Page 10 of 336
