The breadth of this unfolding public health crisis will not be known for years or <br />decades, while industry denial of health effects continues. We urge you to examine this issue <br />carefully, obtain counsel and move forward with a strong protective ordinance. <br /> <br /> <br /> <br />Stronger Wireless Facilities Ordinances <br /> <br />Stronger ordinances for wireless facilities shift some of the responsibility back to the cell tower <br />companies and carriers, rather than allowing the health and financial burden to be on the local <br />municipalities, or worse yet on the residents. The Telecommunications Act of 1996 still requires <br />demonstration of a need for the cell tower for personal communication. Cities can require written <br />proof of studies of the “Gap in coverage” with FCC drive test data and also require that least <br />intrusive methods are used to remedy the gap before allowing a cell tower permit. (See Ithaca <br />Ordinance) Cities also need to maintain public participation and hearings for cell tower permits. <br />It is always best to consult with an independent cell tower attorney when writing an ordinance. <br />Here are examples of what some cities have done. Ithaca in particular has looked at the <br />experience of others in past ordinances, what has worked, what needs to be included and what is <br />legally acceptable. <br /> <br /> <br /> <br />City of Ithaca 2023- <br />https://ehtrust.org/wp-content/uploads/Town-of-Ithaca-new-telecommunications-codes.pdf <br /> <br />• A 1500 foot setback between antennas (old code: 0 feet) <br />• A 250 foot setback between antennas and homes/schools (old code: 8 feet) <br />(Note: Although a 1500 foot setback would be better, since schools are in dense residential <br />areas, this provision will achieve a similar result.) <br />• Abiding by the Priority of Siting locations.
