The City and the Owner entered into that certain Regulatory Agreement and <br />Declaration of Restrictive Covenants dated February 1, 2022 for the Property more particularly <br />described in Exhibit A (attached hereto for reference), and recorded in the official records of San <br />Mateo County on February 8, 2022, as Instrument No. 2022-011753 ("Regulatory Agreement"). <br />B. The City amended Article 29, Requirements for Affordable Housing of the City's <br />Zoning Code in 2023 to make the affordable rent requirements for affordable housing consistent <br />with State law requirements. <br />C. On April 18, 2025, the Zoning Administrator approved a minor amendment to the <br />Conditions of Approval, which amended condition 30 (f), the Affordable Housing Agreement for <br />Parcel F, amending the affordable rent consistent with Article 29.2.D of the City's Zoning Code. <br />D. The City and the Owner now desire to amend the Regulatory Agreement in <br />accordance with this First Amendment to conform to the amendments to the City's Requirements <br />for Affordable Dousing, Article 29 and other terms set forth herein. <br />THEREFORE, the City and the Owner hereby agree as follows: <br />REV: 04-10-25 LF <br />ATTY/AGR.2025/Amend.
