or its agents; <br />(d) An agreement by the Qualifying Household that the Owner may <br />institute a lawsuit, involving or affecting the Qualifying Household or any of its members, without <br />notice to the Qualifying Household; <br />(e) An agreement by the Qualifying Household that the Owner may <br />evict the Qualifying Household without instituting a civil court proceeding in which the Qualifying <br />Household has an opportunity to present a defense or before a court decision on the respective <br />rights of the Owner and the Qualifying Household; <br />(f) An agreement by the Qualifying Household to waive any right to a <br />trial by jury; <br />(g) An agreement by the Qualifying Household to waive the Qualifying <br />Household's right to appeal or to otherwise challenge a court decision in connection with the lease; <br />(h) An agreement by the Qualifying Household to pay attorney's fees <br />or other legal costs, even if the Qualifying Household wins in a court proceeding by the Owner <br />against the Qualifying Household; provided, however, the Qualifying Household may be obligated <br />to pay costs if the Qualifying Household loses such a legal action; <br />(i) An agreement by the Qualifying Household to pay one (1) or more <br />security deposits (or the equivalent) totaling in excess of the amount of one month's rent for such <br />Affordable Unit. Failure to pay any security deposit installment may constitute a breach of the <br />lease. <br />2.9.6 Each lease for an Affordable Unit shall contain all of the following <br />provisions: <br />(a) An agreement authorizing the Owner to immediately terminate the <br />tenancy of a Qualifying Household occupying an Affordable Unit, where one or more members of <br />that Qualifying Household misrepresented any fact material to the qualification of such household <br />as a Qualifying Household; <br />(b) An agreement providing that each Qualifying Household occupying <br />an Affordable Unit shall be subject to annual certification or recertification of income as a <br />condition to continued occupancy of the Affordable Unit; <br />(c) An agreement providing that each Qualifying Household occupying <br />an Affordable Unit may be subject to rental increases in accordance with this Regulatory <br />Agreement; <br />(d) Providing that the Owner will not discriminate on the basis of race, <br />creed, color, gender, sexual orientation, national origin, ancestry, religion, marital status, age, <br />disability or receipt of public assistance or housing assistance in connection with rental of an <br />Affordable Unit, or in connection with the employment or application for employment of persons <br />for operation and management of the Development, and all contracts, applications and leases <br />entered into for such purposes shall contain similar non-discrimination clauses to such effect; and <br />REV: 05-20-25 LF <br />ATTY/AGR.2025.100.3/HEART-SV (417 Stambaugh - Regulatory Agreement) (Page 14 of 35) <br />
