Shouid licensing and criminai background check for operators and employees be <br /> required? <br /> 7. If licensing is required, with what frequency should licenses be renewed? <br /> Pursuant to Government Code section 65858, the City Council may adopt an interim <br /> ordinance to establish a moratorium on the establishment and operation of inedical <br /> marijuana collectives/cooperatives within the City to allow staff additional time to <br /> research the issues. A moratorium ordinance requires a 4/5 majority vote (five out <br /> seven City Council members) for enactment (one reading), is initially effective for 45 <br /> days, and may be extended by a 4/5 majority vote for 22 months and 15 days. If the <br /> City Council were to adopt the attached ordinance, the forty-five day period would end <br /> on, or about January 28, 2010. Thereafter, said ordinance could be extended by a 4/5 <br /> vote for an additional 22 months and 15 days. <br /> California Government Code section 65858 mar�dates that ten days prior to the <br /> expiration of an interim ordinance or any extension thereof, the City Council must issue <br /> a written report describing steps that have been taken to study the issues and establish <br /> appropriate policies and regulations. If the City Counci! adopts the attached ordinance, <br /> issuance of said report would have to occur prior to January 28, 2010. <br /> ALTERNATIVES <br /> 1. Ban medical marijuana collectives outright. <br /> 2. Ailow medical marijuana collectives, but regulate them. <br /> 3.
