7A <br /> Page 6 <br /> WHEREAS, if inedical marijuana collectives were allowed fo be <br /> established without appropriate regulation, such uses might: 1) be established <br /> under conditions that would conflict with the requirements of the General Plan, <br /> the City's Zoning �rdinance (which is about to undergo review and amendmen#), <br /> forthcoming City regulations, and state and/or federal law; 2} be inconsistent with <br /> surrounding uses; and 3} be detrimental to the pub(ic health, safety and welfare; <br /> and <br /> WHEREAS, the City Council desires on an in#erim basis to temporarily <br /> prohibit medical marijuana collectives in the City of Redwood City; and <br /> WHEREAS, this interim ordinance is adopted in accordance with the <br /> requirements of Government Code Section 65858. <br /> NOW, THEREFORE, THE COUNCIL C�F THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> SECTION 1. Purpose and Findings <br /> A. The above recitals are incorporated herein and are each relied <br /> upon independently by the City Council for its adoption of this <br /> interim ordinance. <br /> B. The Redwood City General Plan does not presently contain a <br /> goal or policy of #extual discussion of the issue of a proposed <br /> use of inedical marijuana collectives. <br /> C. The Redwood City Zoning Code and Municipal Code do not <br /> address or reguiate the existence or location of inedical <br /> marijuana collectives, operator licensing, or cultivation of <br /> marijuana plants. <br /> D. The City has received inquires conceming whether collee#ives <br /> are allowed in Redwood City. Coflectives are not listed as <br /> permitted or conditional uses and therefore are currently <br /> prohibited by omission, but a clear policy statement whether and <br /> to what extent collectives are either allowed or not aflowed is <br /> preferred. <br /> E. In cities that have permitted medical marijuana collectives, <br /> issues and concerns have arisen related to the establishment of <br /> Atty/Ord/Ord.327 2 <br /> 120309 <br />
