REV: 05-23-25 LF <br />“ ”EXHIBIT A <br />SCOPE OF SERVICES AND FEE <br />The City Attorney requires the services of an outside expert to evaluate the City’s solid <br />waste rates. Consultant’s solid waste rate study services, as described in detail in this <br />exhibit, is intended to support City Attorney’s evaluation of rates. As such, Consultant’s <br />services will be subject to evidentiary protections under the attorney work product doctrine <br />and/or attorney-client privilege, and all writing communications should be appropriately <br />marked to preserve those protections. <br />The project will result in the establishment of solid waste rates for the calendar year <br />requested by the City. The tasks described below are on an as-needed basis and to be <br />performed by Consultant if requested and approved by the City Attorney or designee. <br />If requested by City, Consultant shall: <br />Establish a yearly project schedule for City approval based on the established <br />compensation and revenue reporting of the South Bayside Waste Management <br />Authority (“SBWMA”) to support the City in its solid waste ratemaking objectives. <br />Create a financial model which accounts for any solid waste service expenses <br />funded by ratemaking, the City’s Rate Stabilization Fund allocated for solid waste <br />rates, rate revenue projections, and the balancing account maintained by Recology <br />for any surpluses or shortfalls occurring between revenues collected from City <br />ratepayers and Recology’s annual compensation. <br />Develop cost-of-service based rates for a time period as requested by City. <br />Demonstrate that the proposed rates reasonably reflect the cost of providing <br />service and are fair and equitable to all customer classes and consistent with <br />Proposition 218. <br />Review the City’s existing solid waste rates and evaluate the pros and cons of <br />other approaches, including revising the structure of the City’s collection rates <br />charged to multi-family and commercial customers. <br />Communicate recommendations based on analysis of alternatives, impacts, and <br />projections for City consideration. Incorporate revisions based on City feedback, <br />as necessary. <br />Prepare draft memoranda and staff reports with solid waste rate analysis findings <br />and recommendations. <br />Assist in the drafting and preparation of the Proposition 218 public hearing notice. <br />Attend public meetings related to the proposed solid waste rates. <br />Make presentations to the Utilities Sub-Committee and/or City Council on the <br />proposed solid waste rates and analysis to provide implementation support for the <br />recommended rates. <br />Conduct a survey of other surrounding agencies’ solid waste rates and summarize <br />findings.
