Subrecipient will maintain <br />documentation that demonstrate s compliance with hour and wage requirements of this <br />part. Such documentation will be made available to the City for review upon request. <br /> <br />28. SECTION 3 OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1968. <br />Subrecipient will comply with the provisions of Section 3, the regulations set forth in 24 <br />CFR Part 75, as that section may be amended from time to time, and all applicable rules <br />and orders of the U.S. Department of Housing and Urban Development. Subrecipient will, <br />to the greatest extent feasible, prioritize making available opportunities for training and <br />employment under this contract to low- and very low-income residents of Redwood City. <br /> <br />Subrecipient will include language specifying required compliance with Section 3 of the <br />Housing and Urban Development Act of 1968 in all subcontracts executed under this <br />Agreement. <br /> <br />Subrecipient certifies and agrees that no contractual or other legal incapacity exists that <br />would prevent compliance with these requirements. <br /> <br />29. LEAD-BASED PAINT. The use of lead-based paint is prohibited. In the event <br />lead-based paint is found on residential property, appropriate abatement procedures may <br />be required by City. Subrecipient agrees that any construction or rehabilitation of <br />residential structures with assistance provided under this Agreement shall be subject to <br />HUD Lead-Based Paint Regulations at 24 CFR Section 570.608 and 24 CFR Part 35, <br />Subpart B. <br /> <br />30. The Build America, Buy America Act: Subrecipient must comply with the <br />requirements of the Build America, Buy America (BABA) Act, 41 USC 8301 note, and all <br />applicable rules and notices, as may be amended, if applicable to the Subrecipient’s <br />infrastructure project. Pursuant to HUD’s Notice, “Public Interest Phased Implementation <br />Waiver for FY 2022 and 2023 of Build America, Buy America Provisions as Applied to <br />Recipients of HUD Federal Financial Assistance” (88 FR 17001), any funds obligated by <br />HUD on or after the applicable listed effective dates, are subject to BABA requirements, <br />unless excepted by a waiver. <br /> <br />31. NOTICES.
