At any time prior to the close of the Public Hearing property owners or ratepayers may submit <br />protests. While both ratepayers and property owners may submit protests, only one protest <br />per parcel shall be counted. <br />In late 2024, Assembly Bill 2257 was enacted, which details procedures that cities can choose to follow <br />when adopting water rates in addition to the ones required by Prop 218. Under AB 2257, property owners <br />and/or ratepayers may both protest and object to the proposed rates. Unlike protests, objections should <br />present an explanation for why they believe proposed rates do not comply with Prop 218 or any other <br />applicable law. <br />Should this action be approved Staff will commence a public outreach campaign which will include the <br />following activities prior to the public hearing. <br />Mail Notices in accordance with the requirements of Proposition 218 <br />Publish notices in a local newspaper in advance of the Public Hearing <br />Host outreach events within the community in both English and Spanish <br />Host in-person and/or virtual community meetings and include Spanish translation <br />Promote events through City social media channels <br />FISCAL IMPACT <br />With the adoption of this Resolution the City will incur the cost to print and mail the Notice of Public <br />Hearing, This cost is anticipated to be approximately $20,000 and is available in the Water Enterprise Fund <br />Budget. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose to not adopt the resolution to initiate proceedings under Proposition 218 <br />and Government Code section 53759.1 to schedule a Public Hearing for proposed water rates and direct <br />staff to revise the study or delay implementation of the proposed rates. <br />6.F. - Page 10 of 111 <br />87
