(a) Approval of Plans and Specifications. Licensee may perform the Permitted Acts <br />on the License Area in accordance with the plans and specifications (including drawings) approved <br />in advance and in writing by the SFPUC and attached as Exhibit D (the "Approved Plans"). The <br />Approved Plans may be revised or amended only with the SFPUC's prior written approval after <br />the SFPUC's Environmental Management Group has determined that no further environmental <br />review is required by the California Environmental Quality Act ("CEQA") as a result of any such <br />revision or amendment. Licensee will install or implement the Facilities in accordance with the <br />Approved Plans. <br />(b) Energy Service and Related Facilities. If Licensee seeks electrical service for <br />use in the License Area, including for any Facilities, Licensee will contact the Interconnection <br />Services Department in the Power Enterprise of the SFPUC to arrange for service. Licensee will <br />purchase all electricity necessary for its operations at the License Area from the SFPUC, at the <br />SFPUC's standard rates charged to third parties, unless the SFPUC determines, in its sole <br />judgment, that it is not feasible to provide service to the License Area. The SFPUC is the provider <br />of electric services to City property, and the SFPUC's Interconnection Services Department <br />coordinates with Pacific Gas and Electric Company and others to implement this Section. Except <br />as provided above with respect to any electricity services provided by the SFPUC, Licensee will <br />arrange and pay for all utilities and services furnished to the License Area, including gas, <br />electricity, water, sewage, telephone, and trash collection services, and for all deposits, connection, <br />and installation charges. <br />Except as otherwise provided in this License, the SFPUC has no responsibility or liability <br />of any kind with respect to any utilities that may be on or about the License Area. Licensee has <br />the sole responsibility to locate any utility facilities within the License Area and protect them from <br />damage resulting from Licensee's use of the License Area. <br />(c) Permits, Licenses, and Approvals. Before beginning any permitted improvement <br />or alteration work in the License Area, Licensee will obtain all permits, licenses, and approvals <br />(collectively, "Approvals") of all regulatory agencies and other third parties that are required to <br />commence, complete, and maintain the permitted work. Promptly upon receipt of any Approvals, <br />Licensee will deliver copies of them to the SFPUC. No approval by the SFPUC for purposes of <br />Licensee's work under this License will be deemed to constitute the approval of any federal, state, <br />or local regulatory authority with jurisdiction, and nothing in this License will limit Licensee's <br />obligation to obtain all regulatory Approvals, at Licensee's sole cost. <br />(d) Limits of City's or SFPUC's Consent. City's or the SFPUC's consent to or <br />approval of any improvements, equipment, or fixtures will not relieve Licensee or its engineers, <br />architects, or contractors from any liability for negligence, errors, or omissions associated with the <br />design and construction of any improvements, equipment, or fixtures. In no event will the <br />SFPUC's approval of plans or specifications be deemed to constitute a representation or warranty <br />by City concerning the suitability of the improvements, equipment, or fixtures for Licensee's <br />purposes or that the work called for in the plans and specifications complies with applicable <br />building codes or other applicable Laws (defined in Section 9 [Compliance with Laws] below), or <br />industry standards, nor will the SFPUC's approval release Licensee from its obligation to supply <br />plans and specifications that conform to applicable building codes, other applicable Laws, and <br />industry standards. <br />5 Rev.
