Contractor provided with its bid for this Agreement a bid guarantee of no less than <br />5% of the bid price, or greater if otherwise required in this Agreement or the City <br />Code. <br />b. Contractor has obtained a performance bond in favor of the City, securing <br />fulfillment of all its obligations under the Agreement, in an amount no less than <br />100% of the Agreement price. <br />c. Contractor has obtained a payment bond, assuring payment as required by law to <br />all persons supplying labor and material in the execution of the work provided for <br />in the Agreement, in an amount no less than 100% of the Agreement price. <br />14. Access to Records. The following access to records requirements apply to this <br />Agreement: <br />a. The Contractor agrees to provide City, the FEMA Administrator, the Comptroller <br />General of the United States, or any of their authorized representatives, access to <br />any books, documents, papers, and records of the Contractor, which are directly <br />pertinent to this Agreement for the purposes of making audits, examinations, <br />excerpts, and transcriptions. <br />b. The Contractor agrees to permit any of the foregoing parties to reproduce by any <br />means whatsoever or to copy excerpts and transcriptions as reasonably needed. <br />c. The Contractor agrees to provide the FEMA Administrator or his or her authorized <br />representatives, access to construction or other work sites pertaining to the work <br />being completed under the Agreement. <br />d. In compliance with the Disaster Recovery Act of 2018, the City and the Contractor <br />acknowledge and agree that no language in this Agreement is intended to prohibit <br />audits or internal reviews by the FEMA Administrator or the Comptroller General <br />of the United States. <br />15. Department of Homeland Security Seal, Logo, and Flags. The Contractor shall not use <br />the DHS seal(s), logos, crests, or reproductions of flags or likenesses of DHS agency <br />officials without specific FEMA pre-approval. <br />16. Compliance with Federal Law, Regulations, and Executive Orders. This is an <br />acknowledgement that FEMA financial assistance will be used to fund all or a portion <br />of the Agreement.
