Code §27383 <br /> <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />(__________________________) [1417 Middlefield Road Subdivision] <br /> <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT (“Agreement”) is made and <br />entered into on this day of __________, 20___ (“Effective Date”) by and between Noventi <br />Qoz Properties LLC, a California Limited Liability Company (“Developer”), and the CITY <br />OF REDWOOD CITY, a charter city and California municipal corporation (“City”) <br />(together, the “Parties”) with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.348 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit “A”, attached hereto and incorporated herein by <br />reference (the “Property”). <br />B. On November 16th, 2021, the Planning Commission of the City of Redwood <br />City adopted, among other approvals, Resolution No. 21-12, approving the Tentative] <br />Map for the 1417 Middlefield Road Subdivision (“Project”), prepared by L. Wade <br />Hammond Civil Engineering & Land Surveying and dated April 19th, 2021 (“Tentative <br />Map”), subject to certain conditions of approval (“Conditions”). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the parcel map (“Parcel Map”), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Parcel Map and applied to City for Parcel Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66411.1. <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />1417 Middlefield Road Improvement Plans, prepared by L. Wade Hammond Civil <br />Engineering & Land Surveying and dated ____________, 20___ (the “Improvement <br />Plans”), which, in addition to other improvements, provide for certain on-site public <br />7.H. - Page 5 of 27 <br />116
