2. You have agreed in writing in a contract or agreement that this insurance would be primary and <br />would not seek contribution from any other insurance available to the additional insured. <br />III. Unintentional Omission <br />The following is added to Section III — Common Policy Conditions: <br />Unintentional Omission <br />By accepting this policy, you agree and represent: <br />a. The statements in the Declarations are truthful, accurate and complete; <br />b. Those statements are based upon representations you made to us; and <br />c. We have issued this policy in reliance upon your representations being truthful, accurate and <br />complete. <br />The unintentional omission of, or unintentional error in, any information provided by you shall not <br />prejudice your rights under this policy. However, it does not affect our right to collect additional <br />premium from the day coverage commenced or our right of cancellation or nonrenewal in <br />accordance with applicable state insurance laws, codes or regulations. This shall not constitute a <br />waiver of our right to rescind this policy, if permitted under state insurance law, due to an <br />intentional or knowing misrepresentation or omission of a material fact.
