REV: 07-17-25 MI <br />E. The Consultant shall hold the hearing within twenty (20) City working days of the City <br />Clerk's receipt of the written appeal. The Hearing Officer shall provide notice of the appeal <br />date and time at least ten (10) City working days before the hearing. <br />F. The City shall provide reasonable prior notice to the Consultant regarding the scheduling <br />of hearings, and the City shall provide any relevant documents to the Consultant, generally <br />at least seven (7) City working days prior to the hearing. <br />G. Prior to the date and time of the hearing, the Consultant shall review all relevant <br />documents, including all relevant laws, ordinances, resolutions, regulations, or policies <br />governing the subject matter of the hearing. <br />H. The Consultant shall issue a written decision following the hearing. The Consultant shall <br />promptly issue the written decision to the City’s Authorized Representative, and each party <br />to the hearing. Unless otherwise specified in the relevant documents noticing the <br />administrative hearing, the Consultant shall endeavor to issue the written decision within <br />twenty (20) City working days of the date of the hearing. <br />4.Compensation. The Consultant’s authorized hearing officer shall perform services under this <br />Agreement at the hourly billing rate of $225 per hour. Billing shall be provided in increments <br />not greater than 1/10th of an hour. Reimbursement of costs advanced by Consultant on behalf <br />of the City, as well as other expenses, will be billed in addition to the amount billed for fees. <br />These currently include, but are not limited to, automobile mileage at the authorized IRS rate, <br />actual expenses away from our office on City business, photocopy charges at $0.25/page, <br />and any costs of producing or reproducing photographs, documents and other items <br />necessary for legal representation. <br />A. In order to request payment, Consultant shall submit invoices to the City identifying the <br />services performed and the charges therefore, identifying (segregated for each matter): <br />an identification of personnel who performed the services, hours worked, hourly rates, and <br />reimbursable expenses. Each invoice shall include a cover page stating the dollar amount <br />owed and excluding any confidential or sensitive information. <br />B. The Consultant shall endeavor to provide monthly invoices no later than thirty (30) days <br />after the end of the month in which services were performed. <br />ATTY/AGR.2025.177/White Brenner (Administrative Hearing Officer) (Page 12 of 13)
