In addition to the foregoing, the Management Plan shall address the following: <br />(i) The actions to be taken by the Owner to affirmatively market Units in <br />compliance with fair housing laws and in compliance with City's policies and procedures. The <br />Owner will market the Units in languages other than English as required under the City's Language <br />Access Plan, as such may be amended from time to time. Prior to or concurrently with the <br />recordation of this Agreement, the City shall provide Owner with a copy of the City's Language <br />Access Plan and any updates thereto. The Owner, at a minimum, shall provide marketing in <br />Spanish; <br />(ii) Criteria for determining Resident eligibility, including certification of <br />household income and size, and establishing reasonable occupancy standards (which shall not <br />exceed standards established by state and federal fair housing laws and state housing and building <br />codes) and procedures for screening prospective Residents, including obtaining credit reports, <br />unlawful detainer reports, landlord references and criminal background investigations; <br />(iii) A requirement that eligible Residents be selected based on order of <br />application, lottery, or other reasonable method approved by the City, subject to the preferences <br />set forth in Section 2.4(c); <br />(iv) A requirement that ineligible applicants be notified of the reason for their <br />ineligibility; <br />(v) Specific procedures through which applicants deemed to be ineligible <br />may appeal this determination; <br />(vi) A requirement that eligible applicants be notified of eligibility and be <br />provided an estimate regarding when an Affordable Unit may be available; <br />(vii) Maintaining a waiting list of eligible applicants for the Affordable Units; <br />(viii) Specific procedures for obtaining documentation regarding prospective <br />Residents' incomes, as necessary, to certify that such income does not exceed income limits; <br />(ix) Specific procedures for certification and recertification of household <br />incomes and procedures for handling over -income Residents; <br />(x) A requirement that a written rental agreement be executed with each <br />eligible household selected to occupy an Affordable Unit; <br />(xi) A detailed listing of reasonable rules of conduct and occupancy which <br />shall be in writing, shall be consistent with federal and state law, and shall be provided to each <br />Resident upon occupancy; and <br />(xii) Such other requirements and criteria/procedures as the City may <br />determine appropriate. <br />REV: 04-03-25 LF <br />ATTY/AGR.2025.060/112 Vera Ave., L.P.
