SECTION R108.5.1 OF THE RESIDENTIAL CODE ADDED: <br />Section R108.5.1 of the Residential Code is added to read as follows: <br />R108.5.1 Eighty percent (80%) of the permit issuance fees may be refunded to the applicant who made the <br />payment if the permit is cancelled without any work performed. If the scope of a permit is reduced after <br />issuance, a portion of the permit issuance fees proportionate to the reduction in project valuation may be <br />refunded to the applicant who made the payment. <br />Sec. 9.51. SECTION R308.1 OF THE RESIDENTIAL CODE AMENDED: <br />Section R308.1 of the Residential Code is amended to add Section-R308.1.1 to read as follows: <br />R308.1.1 Address numbers shall be illuminated to be visible from the street during darkness. <br />Sec. 9.51. SECTION R902.1.1 OF THE RESIDENTIAL CODE AMENDED: <br />Section 902.1.1 Roof decks shall be covered with materials as set forth in Section R904 or with roof coverings <br />as set forth in Section R905. A minimum Class A or B roofing shall be installed in areas designated by this section <br />or where the edge of the roof deck is less than 3 feet (914 mm) from a lot line. Where Class A or B roof <br />assemblies are required, they shall be tested in accordance with ASTM E108 or UL 790. Where required, the <br />roof assembly shall be listed and identified as to class by an approved testing agency. <br />Sec. 9.52. RESERVED. <br />Sec. 9.53. SECTION J102.1, APPENDIX J OF THE BUILDING CODE AMENDED: <br />Section J102.1, Appendix J – Grading, of the Building Code is amended to add a definition of Engineered Grading: <br />ENGINEERED GRADING. An excavation greater than two (2) feet in depth; where cut slope is greater than five <br />(5) feet in height; where fill is to be placed on natural grade steeper than 20% (1:5 ratio); where fill is greater <br />than three (3) feet in height; where fill supports a structure; or where more than 50 cubic yards of fill is placed. <br />Sec. 9.54. APPENDIX J OF THE BUILDING CODE AMENDED: <br />Appendix J of the Building Code is amended to replace the words 'Building Official' with the words 'City Engineer' at <br />all locations in this appendix where the words 'Building Official' are found. <br />Sec. 9.55. SECTION J103.2 (1), APPENDIX J OF THE BUILDING CODE AMENDED: <br />Appendix J - Grading, Section J103.2 (1) of the Building Code is amended to read as follows: <br />J103.2 Exemptions. A grading permit shall not be required for the following: <br />1. Grading in an isolated, self-contained area, provided there is no danger to the public, and that such <br />grading will not adversely affect adjoining properties and the amount of grading is less than 50 cubic <br />yards, unless the grading meets the definition of Engineered Grading. <br />Sec. 9.56. SECTION J103.3, APPENDIX J OF THE BUILDING CODE ADDED: <br />Appendix J - Grading. Section J103.3 of the Building Code is added to read as follows: <br />J103.3 Grading Fees. At the time of filing for a grading permit, the applicant shall deposit funds to cover the <br />costs of engineering services for plan review and inspection. Engineering services are provided on an actual <br />cost basis. Actual costs are determined by the fully burdened hourly rates by position performing service. The <br />rates, as established through resolution of the City Council, are on file with the City Clerk. Separate plan review <br />and permit fees shall apply to retaining walls or major drainage structures as required elsewhere in this code.
