Manner. Landlord must provide this notice to prospective tenants in <br />writing or electronically if the rental application and/or lease are processed <br />electronically, or both if both methods are utilized. <br /> <br />E. Applicability. This Section shall apply to all rental units as defined in this <br />Chapter except as set forth below: <br /> <br />1. A dwelling unit that serves as the owner’s primary residence that is <br />occupied as a short term rental in accordance with Section 31.3 of the <br />Redwood City Code. <br /> <br />2. A rental unit occupied by a tenant who subleases that unit to another <br />tenant for less than one (1) year. <br /> <br />3. A rental unit where the tenancy is an express condition of, or <br />consideration for, employment under a written lease or contract or a unit <br />leased to a corporation. <br /> <br />42.5 Just Cause for Eviction Protections <br /> <br />A. Just Cause for Eviction Required. Notwithstanding any other law, after a <br />tenant has continuously and lawfully occupied a rental unit for 12 months, the <br />landlord shall not terminate the tenancy without just cause, which shall be stated <br />in the written notice to terminate tenancy. If any additional adult tenants are added <br />to the lease before an existing tenant has continuously and lawfully occupied the <br />rental unit for 24 months, then this Section 42.5 shall only apply if either of the <br />following are satisfied: <br /> <br />1. All of the tenants have continuously and lawfully occupied the rental <br />unit for twelve (12) months or more. <br /> <br />2. One (1) or more of the tenants have continuously and lawfully <br />occupied the rental unit for 24 months or more. <br /> <br />B. Just Cause Defined. For purposes of this Chapter, “just cause” means either <br />of the following: <br /> <br />1. At-fault just cause, which means any of the following: <br /> <br />a. Default in the payment of rent. <br /> <br />b. A breach of a material term of the lease, as described in the <br />Code of Civil Procedure Section 1161(3), including, but not limited <br />9.A. - Page 23 of 84 <br />128
