ATTY/ORD.0007/CC ORD TEMPORARILY AMENDING ZONING CODE (AFFORDABLE HOUSING INCENTIVE PROGRAM) <br />REV: 08-27-25 VR <br />Page 6 of 6 <br />4. The conditions of approval related to the City’s requirements for <br />affordable housing; <br /> <br />5. The affordable housing plan and/or affordable housing agreement; <br /> <br />6. The affordability covenants; <br /> <br />7. The “no net loss” findings required under Government Code Section <br />65863; and/or <br /> <br />8. Any and all related affordable housing documentation that may be <br />necessary to ensure compliance with Article 29 or other applicable laws. <br /> <br />Any modification to entitlements made pursuant to this Ordinance shall include a <br />condition that a Pipeline Project must secure a building permit on residential <br />development on or before June 30, 2027 and pay all other City impact fees <br />applicable to the affordability levels of the units (e.g., Parks Impact Fees and <br />Transportation Impact Fees), and if an applicant fails to do so, the affordable <br />housing requirements applicable to the project shall automatically revert to those <br />AHO requirements prior to the adoption of this Ordinance. <br /> <br />F. Continued Validity of Affordable Housing Ordinance. Except as <br />expressly provided for in this Ordinance, all provisions of Article 29 shall remain in <br />full force and effect. <br /> <br />SECTION 5. SAVINGS CLAUSE <br /> <br />If any section, subsection, clause or phrase of this Ordinance is for any reason <br />held to be invalid, such decision shall not affect the validity of the remaining portion or <br />sections of the Ordinance. The City Council hereby declares that it would have adopted <br />the Ordinance and each section, subsection, sentence, clause or phrase thereof <br />irrespective of the fact that any one or more sections, subsections, sentences, clauses or <br />phrases be declared unconstitutional. <br /> <br />SECTION 6. PUBLICATION <br /> <br />The City Clerk shall publish this Ordinance as an uncodified ordinance in <br />accordance with applicable law. <br /> <br />SECTION 7. EFFECTIVE DATE AND SUNSET PROVISION <br /> <br />This Ordinance shall be effective thirty (30) days after its adoption. This Ordinance <br />shall expire by operation of law on June 30, 2027, unless extended by a resolution of the <br />City Council adopted before that date. <br /> <br />* * *
