ATTY/AGR/SETTLEMENTS/2025/ECHEMA/SETTLEMENT AGREEMENT & MUTUAL RELEASE – ECHEMA <br />REV: 10-10-25 MI <br />Page 4 of 7 <br /> <br />A general release does not extend to claims that the creditor or releasing party <br />does not know or suspect to exist in his or her favor at the time of executing <br />the release, and that, if known by him or her, would have materially affected <br />his or her settlement with the debtor or released party. <br /> <br />As to any and all claims released by this Agreement, the Parties waive and relinquish any <br />rights and benefits they may have under Section 1542 of the Civil Code of the State of California <br />to the full extent that they may lawfully waive all such rights and benefits. The Parties <br />acknowledge that they are aware that they may hereafter discover facts in addition to or different <br />from those which they now know or believe to be true with respect to the subject matter of this <br />Agreement, but it is their intention to hereby settle and release, fully and finally, any and all <br />matters, disputes, and differences, known and unknown, suspected and unsuspected, which do now <br />exist, may exist or heretofore have existed that relate to or arise out of Plaintiff’s employment or <br />the Action. In furtherance of this intention, the release herein given shall be and remain in effect <br />as a full and complete release notwithstanding discovery or the existence of any such additional or <br />different facts. <br /> <br />PLAINTIFF’S INITIALS ________ <br /> <br />8. No Unreported Work-Related Injuries. Plaintiff covenants and agrees that he <br />suffered no known unreported work-related injuries during his employment with City other than <br />those which have already been the subject of work-related injury claims by Plaintiff. <br /> <br />9. No Dispute Regarding Payment of Prior Wages. Plaintiff expressly warrants <br />and agrees that, as of the date of executing this Agreement, he has accurately reported all his hours <br />worked (both straight time and overtime), and that he did not work any time “off the clock” <br />(whether straight time or overtime) that was not reported on his timecards. Further, Plaintiff <br />expressly warrants and agrees that, as of the date of executing this Agreement, he does not dispute <br />as inaccurate any wages previously paid to him. <br /> <br />10. References and Third Party Inquiries. <br /> <br />(a) The Parties expressly agree not to issue any press release or discuss this Agreement <br />or the underlying dispute, including individual allegations and/or the resolution thereof, with any <br />media representative, whether on or off the record, or on any social media platform. If queried <br />about this Agreement by any media-related party or agent, the Parties expressly agree that they <br />will only say: “The matter has been resolved” or words of similar meaning. <br /> <br />(b) Plaintiff agrees to direct employment verifications, third-party inquiries or other <br />reference checks regarding his City employment to City’s Human Resources Director (Michelle <br />Katsuyoshi) or her successor. Other than dates of employment and positions held, employment <br />information about Plaintiff (including, but not limited to this Agreement) will be released to such <br />parties by City only (a) with Plaintiff’s written consent, (b) to refute or defend a claim or allegation <br />by or on behalf of Plaintiff, or (c) as otherwise required by law (e.g. subpoena, California Public <br />Records Act request, etc.).
