<br />certain provisions of the LFIA that require an initial payment at the time the City acquired the New Levee
<br />and therefore need to amend the LFIA. Finally, after acceptance of the New Levee, the City will not need
<br />some portions of the Seaport Centre Levee constructed in 1985. The City wishes to vacate those portions.
<br />Acceptance of Seaport Levee Improvements
<br />The LFIA dictated the terms of construction for the New Levee. SCOA was required to bid and award the
<br />project through the same process that the City follows for its capital improvement project program. SCOA
<br />and the project design and construction management company, BKF Engineers, prepared the necessary
<br />plans and specification documents and a budget, and they were reviewed and approved by the City
<br />Engineer prior to bidding. The LFIA also dictated that a committee was required to be formed which
<br />included two persons from Stonybrook Associates, Inc. (a representative of SCOA), two employees of BKF,
<br />and a City staff member from the City Engineering Department (“Committee”) to review and recommend
<br />approval of any changes to the construction plans or the budget.
<br />In March of 2021, SCOA bid the project with the assistance of City staff. The bid was awarded by the
<br />Committee to the lowest responsive and responsible bidder Granite Rock Company (“Granite”) of
<br />Redwood City, in the amount of $5,359,230. The City subsequently issued a permit to Granite for the
<br />tracking and inspection of the project in accordance with the LFIA.
<br />The initial budget was $11,750,053 and included pre-construction costs, construction costs, the cost for
<br />the City to obtain title insurance for the New Levee, City inspection and plan review costs, City and SCOA’s
<br />consultant costs, FEMA accreditation costs, the cost of a warranty bond for the New Levee, and CFD
<br />formation costs. City staff approved 14 change orders during construction, which were due to later-found
<br />utilities conflicts, additional landscaping needed for restoration, and additional improvements needed in
<br />and around the Port of Redwood City’s boat launch area. The construction phase budget was modified to
<br />accommodate the change orders and other necessary construction support, including project
<br />management, testing, inspection, permitting, etc. The final, adjusted construction budget was $8,843,964.
<br />The project was delivered within the 10% contingency of the overall construction phase budget and the
<br />actual construction costs were $8,171,491. The total final adjusted budget was $12,812,113 and the total
<br />actual costs were $12,507,893. City staff has reviewed SCOA’s accounting of the total actual costs and has
<br />determined the $12,507,893 figure is appropriate. As the lesser of the final budget and the final actual
<br />costs, $12,507,893 will be the purchase price for the New Levee.
<br />In November 2022, construction of the New Levee was substantially completed in compliance with the
<br />plans and change orders approved pursuant to the LFIA, the City Code, and other City Standards to the
<br />satisfaction of the City Engineer, and all punch list items have been completed. FEMA has also accredited
<br />the New Levee. Therefore, the City Engineer recommends acceptance of the New Levee.
<br />Summary Easement Vacation
<br />A Deed of Easements recorded on January 19, 1986 (“1986 Easement”) gives the City the right to access
<br />and maintain the Seaport Centre Levee. The 1986 Easement is attached as Attachment D. Portions of the
<br />existing 1986 Easement that are no longer needed in light of the configuration of the New Levee will be
