The City’s installment payments from CFD special tax proceeds <br />will reimburse HCP, MetLife and SCOA for those costs. HCP, MetLife and SCOA have also agreed to pay for <br />all annual costs associated with administering the special tax. <br />A facilities special tax and an annual perpetual services special tax will be levied on the Seaport Centre <br />and Seaport Plaza properties. Due to the timing of the acquisition and acceptance of the Seaport <br />Centre/Plaza Levee Improvements conflicting with the County’s tax levy assessment deadline, payment <br />for the first year of the 15-year term for the facilities special tax will be collected through direct billing <br />rather than inclusion on the County tax roll assessment. Subsequent annual payments for the facilities <br />special tax will be levied via the County tax assessment roll on the Seaport Centre and Seaport Plaza <br />properties to finance the City’s purchase of the New Levee. A perpetual services special tax will be levied <br />on the Seaport Centre and Seaport Plaza properties to generate funds needed by City to pay the ongoing <br />operation and maintenance costs of the New Levee and Wet Utilities. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, Section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. This activity simply authorizes acceptance of <br />facilities that have been constructed in accordance with the LFIA, as authorized on October 26, 2020, and <br />the Second Amendment to the LFIA authorizes use of funds for certain maintenance activities <br />contemplated by the CFD rate and method incorporated in the CFD formation resolution. Moreover, on <br />October 26, 2020, the City Council determined that Seaport Levee Improvements were categorically <br />exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to State <br />CEQA Guidelines, 14 CCR §§ 15000, et seq., Sections 15301 (Class 1. Existing Facilities), 15302 (Class 2. <br />Replacement or Reconstruction), 15304 (Class 4. Minor Alterations to Land), and 15311 (Class 11. <br />Accessory Structures). A Notice of Exemption was filed on February 4, 2021. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />If the Council determines that the conditions for adopting the three resolutions have not been met, <br />direct staff to conduct additional analysis or address any outstanding questions or issues. <br />8.C. - Page 6 of 117 <br />196
