<br /> <br />ATTY/RESO.0080/CC RESO ACCEPTANCE LEVEE IMPROVEMENTS <br />REV: 10-17-25 VR <br />Page 3 of 3 <br /> <br />SECTION 3. The City Council accepts the Levee Improvements as complete. The <br />City’s acceptance is effective as of the date the deeds from each of the Owners, Stanford, <br />and SCOA, as described in Section 7, are recorded. <br /> <br />SECTION 4. The City Council authorizes the City Engineer to execute and the City <br />Clerk to record a Notice of Completion for the Levee Improvements. <br /> <br />SECTION 5. The City Clerk is authorized to release the payment bond for the <br />Levee Improvements 35 days from the recordation of the Notice of Completion and upon <br />verification that no liens have been levied against the Levee Improvements. <br /> <br />SECTION 6. The City Clerk is authorized to release the performance bond for the <br />Levee Improvements upon the receipt of a warranty bond in a form acceptable to the <br />Public Works Director in the amount of $1,281,211.30 (i.e. 10% of the Final Design and <br />Construction Budget). <br /> <br />SECTION 7. The City Manager or their designee is authorized to a) accept a Grant <br />Deed from each of the Owners and a Quitclaim Deed from Stanford conveying City the <br />Levee Improvements; b) accept an Easement Deed from each of the Owners and an <br />Encroachment Easement Deed and Agreement from Stanford conveying the necessary <br />rights-of-way and easements for access, repair, maintenance, and use of such Levee <br />Improvements; c) to accept from SCOA quitclaim deeds relinquishing any interest SCOA <br />may have in the Levee Improvements; and d) to execute and record certificates of <br />acceptance of the Grant Deeds, Easement Deeds, Encroachment Easement Deed and <br />Agreement, and Quitclaim Deeds described herein. <br /> <br /> <br /> <br />* * *
