ATTY/RESO.0108/CC RESO APPROVING AMENDMENT NO. 2 TO RECOLOGY SAN MATEO FRANCHISE AGREEMENT <br />REV: 11-04-25 MI <br />Page 2 of 2 <br />WHEREAS, the City published notice of the public hearing at which the maximum solid <br />waste collection rates and the franchise fees would be considered on October 30, 2025 and <br />November 6, 2025. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br /> <br />1. This resolution has been reviewed with respect to applicability of the California <br />Environmental Quality Act (“CEQA”) and the CEQA Guidelines. The resolution is not a project <br />pursuant to CEQA Guidelines section 15378(b)(4) because the City is setting maximum rates for <br />solid waste collection to be charged to fund on-going solid waste collection services by Recology <br />San Mateo County and setting franchise fees for City services, property and facilities provided for <br />solid waste services, and as such, the action involves a funding mechanism or fiscal activity within <br />the meaning of the CEQA Guidelines. <br /> <br />2. The schedule of maximum charges for solid waste collection services in the City <br />of Redwood City is hereby approved as set forth in Exhibit A, attached hereto and incorporated <br />herein. <br /> <br />3. Amendment No. 2 to the Amended and Restated Franchise Agreement with <br />Recology San Mateo is hereby approved as set forth in Exhibit B, attached hereto and <br />incorporated herein. <br /> <br />4. The Franchise Fee, AB 939 Fee, and Administrative Fee are hereby adopted, <br />pursuant to California Health and Safety Code section 5471, as set forth in Attachment M to <br />Amendment 2 to the Amended and Restated Franchise Agreement With Recology San Mateo. <br /> <br />5. The Franchise Fee, AB 939 Fee, and Administrative Fee are justified by the <br />Franchise Fee Study, adopted by the City Council effective February 1, 2025, comply with Section <br />1 of Article XIII C of the California Constitution, and do not exceed the City’s total costs of providing <br />solid waste-related services, privileges, and benefits to Recology and the reasonable value of City <br />property used for solid waste services. <br /> <br />6. This resolution shall be effective January 1, 2026. <br /> <br /> <br /> <br />* * * <br />
