This Chapter shall be known and may be cited as the “Tenant Protection <br />Ordinance.” <br /> <br />B. The requirements established pursuant to this Chapter are adopted under <br />the authority of California Constitution Article XI, Section 7, which provides: “A <br />county or city may make and enforce within its limits all local, police, sanitary, and <br />other ordinances and regulations not in conflict with general laws,” and in <br />accordance with the purpose set forth in the Ordinance codified in this Chapter. <br /> <br />C. This Chapter shall apply to the extent permitted by the statutes and laws of <br />the State of California. <br /> <br />D. Pursuant to Civil Code Section 1946.2(i)(2), a rental unit shall not be subject <br />to both a local ordinance requiring just cause for termination of a residential <br />tenancy and Civil Code Section 1946.2. Therefore, to the extent a rental unit is <br />covered by this Chapter, such rental unit will not be subject to Civil Code Section <br />1946.2. <br /> <br />42.2 Findings and Purpose <br /> <br />A. Findings. Pursuant to Civil Code Section 1946.2(i)(1)(B)(iii), the City Council <br />finds that this Chapter is more protective than the provisions of Civil Code Section <br />1946.2 because: <br /> <br />1. The just causes for termination of a residential tenancy under this <br />Chapter are consistent with Civil Code Section 1946.2.
