However, as discussed earlier, these adjustments have led to increased <br />costs in their respective domains, resulting in the request for approval of amendments to their <br />agreements. <br />Given the importance of the Veterans Memorial Building/Senior Center to the community, it is critical to <br />maintain the quality and integrity of the project, even in the face of these delays. Therefore, it is <br />recommended that the City Council approve the proposed increases to ELS Architecture and Urban <br />Design’s administrative fees and Gilbane’s project management fees to ensure the successful completion <br />of the project. <br />EQUITY IMPACT STATEMENT <br />All City actions are assessed for impact. Because this item is on the consent calendar, this section indicates <br />assessment process, not findings. The anticipated impact of this policy, program, or action has been <br />assessed by conducting community engagement with the population(s) most affected by this action. <br />FISCAL IMPACT <br />Under the terms of the Project Extension Agreement with TBC, TBC will reimburse the City for the costs <br />incurred from the proposed contract amendments with ELS and Gilbane. If the City does not receive <br />reimbursements for the FY 2025-26 costs incurred from the proposed contract amendments with ELS and <br />Gilbane by December 1, 2025, a mid-year budget amendment will be proposed to appropriate up to <br />$727,991 in unallocated FY 2025-26 General Fund fund balance to cover the cost of the proposed <br />amendments. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />7.C. - Page 6 of 15 <br />107
