COMPLIANCE WITH CHAPTER REQUIRED: <br />Unless otherwise specifically provided herein, upon notification by the Health Officer or his representative, all <br />persons shall comply with the provisions of this Chapter or be deemed guilty of a misdemeanor. <br />ARTICLE II. REFUSE RECEPTACLES1 <br />1 Health & S.C. §§ 17809, 17810. <br />Sec. 14.11. DUTY TO PROVIDE; SIZE, QUALITIES AND NUMBER REQUIRED: <br />Every person in possession or control of any boarding house, restaurant, cafe, hotel, apartment or short-term rental, <br />dwelling house or flat, and every other person having refuse in the City shall provide, or cause to be provided and at <br />all times keep, or cause to be kept, suitable and sufficient watertight cans or receptacles, adequate to contain <br />without leakage or escape of odors the amount of garbage and waste matter ordinarily accumulating at such place <br />during the intervals between collections made under this Chapter. <br />Sec. 14.12. CONSTRUCTION: <br />Each watertight can or receptacle for garbage, recyclables, organic materials or other waste matter shall be <br />constructed of material approved by the Building Inspector of the City and shall have suitable bales or handles on <br />the outside. <br />Sec. 14.13. DUTY TO KEEP SANITARY; REMOVAL OF COVERS; TYPE OF COVERS: <br />Containers for garbage, recyclables and organic materials shall be kept in a sanitary condition by the owners thereof <br />and the covers shall not be removed or left open except for the purpose of placing refuse therein or removing refuse <br />therefrom, and shall at all times be proof against access of flies to the contents thereof. <br />Sec. 14.14. DUTY OF CONTRACTOR ON CONSTRUCTION LOCATION: <br />Every contractor or builder engaged in the erection or repair of a building is to provide a receptacle at or near such <br />building being so erected or repaired, within which receptacle shall be deposited any garbage, or other refuse cast <br />aside by the employees or workmen engaged in such building. <br />Sec. 14.15. PLACEMENT OF CONTAINERS OF GARBAGE, RECYCLABLES, AND ORGANIC <br />MATERIALS FOR COLLECTION: <br />A.Every person in possession, charge, or control of any premises shall provide a sufficient number of <br />containers of sufficient capacity to hold all garbage, recyclables, and organic materials which are created, <br />produced, or accumulated on such premises between the times of successive collections by the collector. <br />Persons who have successfully obtained a waiver from the City pursuant to subsection (B) of Section 14.2 <br />of this Chapter shall provide a sufficient number of containers of sufficient capacity to hold all garbage, <br />recyclables, and organic materials which are created, produced, or accumulated on such premises between <br />the times of successive self-haul disposals. <br />B.Containers shall be placed curbside or street side in a manner that does not block any driveway, sidewalk <br />or street, or impede pedestrian or vehicular traffic or sight lines. <br />C.Containers may be placed curbside or street side so as to be readily accessible for removing and emptying <br />by the refuse collector only between twelve o'clock (12:00) noon on the day preceding the scheduled <br />collection and twelve o'clock (12:00) noon on the day immediately following the collection of refuse.
