Contract Provisions Guide <br />37 <br /> <br />Definitions <br /> Contract: A legal instrument by which a FEMA award recipient or subrecipient purchases property <br />or services needed to carry out the project or program under a federal award.76 A contract, for <br />the purposes of this Guide, does not mean a federal award or subaward. <br /> Contractor: Contractor means an entity that receives a contract.77 <br /> Cooperative agreement: A legal instrument of financial assistance between a federal awarding <br />agency or pass-through entity and a non-Federal entity, that is consistent with 31 U.S.C. 6302- <br />6305.78 <br /> Federal awarding agency: The federal agency that provides a federal award directly to a non- <br />Federal entity (NFE). The federal awarding agency discussed in this Guide is FEMA. <br /> Federal Emergency Management Agency (FEMA): FEMA’s statutory mission is to reduce the loss <br />of life and property and protect the Nation from all hazards, including natural disasters, acts of <br />terrorism, and other man-made disasters, by leading and supporting the Nation in a risk-based, <br />comprehensive emergency management system of preparedness, protection, response, <br />recovery, and mitigation.79 Among other things: <br />o FEMA administers its programs and carries out its activities through its headquarters <br />offices in Washington, D.C.; ten Regional Offices; Area Offices for the Pacific, Caribbean, <br />and Alaska; various Recovery Offices; and temporary Joint Field Offices (JFO). <br />o FEMA administers numerous assistance programs annually for on a regular basis to <br />increase the Nation’s preparedness, readiness and resilience to all hazards. These <br />assistance programs are typically available to NFEs including, but not limited to, states, <br />local governments, Indian Tribes, universities, hospitals, and certain private nonprofit <br />organizations. <br />o Each program is governed by the applicable federal law, regulations, executive orders <br />and FEMA program-specific policies. As the Federal awarding agency for these programs, <br />FEMA is responsible for the proper management and administration of these programs <br />as otherwise required by law and enforcing the terms of the agreements it enters with <br />NFEs that receive FEMA financial assistance, consistent with the requirements at 2 <br />C.F.R.
