ATTY/ORD.0014/CC ORD ENGINEERING AND TRANSPORTATION CODE UPDATES – EXHIBIT A <br />REV: 11-18-25 LR <br />Page 1 of 1 <br /> <br />EXHIBIT A – AMENDING SECTION 18.242 - UNDERGROUND UTILITIES <br /> <br />A. Upon the construction of any new commercial or residential building of four (4) <br />units or more, the electrical, telephone and cable TV lines will be installed <br />underground along the street frontage as well as on the subject property. In lieu of <br />the underground requirements along the street frontage associated with the <br />construction of a new commercial or residential building of four (4) units or more, <br />or a minor subdivision with four (4) or fewer lots, a developer may pay a fee, as <br />established by resolution of the City Council, into the City's Utility Undergrounding <br />Fund. Said fee will not exceed the costs associated with the required <br />undergrounding. <br />B. Upon the construction of any new residential building (three (3) units or less), the <br />overhead services servicing the building shall be undergrounded. This may require <br />design, permitting, and construction outside of the property boundary. In lieu of the <br />underground requirements for the overhead services associated with the <br />construction of a new residential building, a developer may pay a fee, as <br />established by resolution of the City Council, into the City's Utility Undergrounding <br />Fund. Said fee will not exceed the costs associated with the required <br />undergrounding. The City Engineer shall have the discretion to grant hardship <br />exception to this requirement based on the following factors, including, but not <br />limited to: whether there is sufficient rights/interest/title for the undergrounding, <br />location of the nearest pole(s), and location of existing improvement(s) along <br />proposed route of underground conduits. <br />C. Upon the substantial remodeling of a commercial building, the existing and new <br />electrical, telephone, and cable TV lines connected to the building will be installed <br />underground. <br />D. All existing below ground electrical, telephone, communications, and cable TV <br />lines shall remain below ground, including all replaced services and frontage <br />infrastructure. <br />E. This Section will not apply to undergrounding required as part of a subdivision or <br />other permit approval, nor will it apply to new residential buildings in which one <br />hundred percent (100%) of the units are subject to an affordable housing deed <br />restriction.
